66 AN ACT
77 relating to requirements for mental health assignment
88 certification for municipal police departments and sheriff's
99 departments.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 180, Local Government Code, is amended
1212 by adding Section 180.008 to read as follows:
1313 Sec. 180.008. REQUIRED MENTAL HEALTH ASSIGNMENT
1414 CERTIFICATION. Each municipal police department and sheriff's
1515 department shall ensure that the following percentage of officers
1616 are certified under Section 1701.404, Occupations Code:
1717 (1) at least one-fourth of the department's officers
1818 who:
1919 (A) are engaged in traffic or highway patrol or
2020 otherwise detain or stop motor vehicles; or
2121 (B) are primary responders who respond directly
2222 to calls for assistance from the public; and
2323 (2) at least one-fourth of the department's officers
2424 who are on duty during a shift.
2525 SECTION 2. This Act takes effect September 1, 2018.
