10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Chapter 180, Local Government Code, is amended | |
12 | 12 | by adding Section 180.008 to read as follows: | |
13 | 13 | Sec. 180.008. REQUIRED MENTAL HEALTH ASSIGNMENT | |
14 | 14 | CERTIFICATION. Each municipal police department and sheriff's | |
15 | 15 | department shall ensure that the following percentage of officers | |
16 | 16 | are certified under Section 1701.404, Occupations Code: | |
17 | 17 | (1) at least one-fourth of the department's officers | |
18 | 18 | who: | |
19 | 19 | (A) are engaged in traffic or highway patrol or | |
20 | 20 | otherwise detain or stop motor vehicles; or | |
21 | 21 | (B) are primary responders who respond directly | |
22 | 22 | to calls for assistance from the public; and | |
23 | 23 | (2) at least one-fourth of the department's officers | |
24 | 24 | who are on duty during a shift. | |
25 | 25 | SECTION 2. This Act takes effect September 1, 2018. |
