11 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 9 | | SECTION 1. Subchapter A, Chapter 772, Government Code, is |
---|
13 | 10 | | amended by adding Section 772.0073 to read as follows: |
---|
14 | 11 | | Sec. 772.0073. BULLETPROOF VEST AND BODY ARMOR GRANT |
---|
15 | 12 | | PROGRAM. (a) In this section, "criminal justice division" means |
---|
16 | 13 | | the criminal justice division established under Section 772.006. |
---|
17 | 14 | | (b) The criminal justice division shall establish and |
---|
18 | 15 | | administer a grant program to provide financial assistance to a law |
---|
19 | 16 | | enforcement agency in this state that seeks to equip its peace |
---|
20 | 17 | | officers with bulletproof vests, ballistic plates, and plate |
---|
21 | 18 | | carriers. |
---|
22 | 19 | | (c) A vest or plate purchased with a grant received under |
---|
23 | 20 | | this section must comply with a National Institute of Justice |
---|
24 | 21 | | standard for rifle protection. |
---|
25 | 22 | | (d) A law enforcement agency may apply for a grant under |
---|
26 | 23 | | this section only if the agency first adopts a policy addressing |
---|
27 | 24 | | the: |
---|
28 | 25 | | (1) deployment and allocation of vests or plates to |
---|
29 | 26 | | its officers; and |
---|
30 | 27 | | (2) usage of vests or plates by its officers. |
---|
31 | 28 | | (e) A law enforcement agency receiving a grant under this |
---|
32 | 29 | | section must, as soon as practicable after receiving the grant, |
---|
33 | 30 | | provide to the criminal justice division proof of purchase of |
---|
34 | 31 | | bulletproof vests, ballistic plates, and plate carriers, including |
---|
35 | 32 | | the price of each item and the number of each type of item |
---|
36 | 33 | | purchased. |
---|
37 | 34 | | (f) Not later than December 1 of each year, the criminal |
---|
38 | 35 | | justice division shall submit to the Legislative Budget Board a |
---|
39 | 36 | | report that provides the following information for the preceding |
---|
40 | 37 | | state fiscal year: |
---|
41 | 38 | | (1) the name of each law enforcement agency that |
---|
42 | 39 | | applied for a grant under this section; |
---|
43 | 40 | | (2) the amount of money distributed to each law |
---|
44 | 41 | | enforcement agency that received a grant under this section; and |
---|
45 | 42 | | (3) as reported under Subsection (e), the number of |
---|
46 | 43 | | vests, plates, and carriers purchased by each agency described by |
---|
47 | 44 | | Subdivision (2). |
---|
48 | 45 | | (g) The criminal justice division may use any revenue |
---|
49 | 46 | | available for purposes of this section. |
---|
50 | 47 | | SECTION 2. This Act takes effect immediately if it receives |
---|
51 | 48 | | a vote of two-thirds of all the members elected to each house, as |
---|
52 | 49 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
53 | 50 | | Act does not receive the vote necessary for immediate effect, this |
---|
54 | 51 | | Act takes effect September 1, 2017. |
