74 AN ACT
85 relating to the creation of a grant program to assist law
96 enforcement agencies with the purchase of bulletproof vests and
107 body armor.
118 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
129 SECTION 1. Subchapter A, Chapter 772, Government Code, is
1310 amended by adding Section 772.0073 to read as follows:
1411 Sec. 772.0073. BULLETPROOF VEST AND BODY ARMOR GRANT
1512 PROGRAM. (a) In this section, "criminal justice division" means
1613 the criminal justice division established under Section 772.006.
1714 (b) The criminal justice division shall establish and
1815 administer a grant program to provide financial assistance to a law
1916 enforcement agency in this state that seeks to equip its peace
2017 officers with bulletproof vests, ballistic plates, and plate
2118 carriers.
2219 (c) A vest or plate purchased with a grant received under
2320 this section must comply with a National Institute of Justice
2421 standard for rifle protection.
2522 (d) A law enforcement agency may apply for a grant under
2623 this section only if the agency first adopts a policy addressing
2724 the:
2825 (1) deployment and allocation of vests or plates to
2926 its officers; and
3027 (2) usage of vests or plates by its officers.
3128 (e) A law enforcement agency receiving a grant under this
3229 section must, as soon as practicable after receiving the grant,
3330 provide to the criminal justice division proof of purchase of
3431 bulletproof vests, ballistic plates, and plate carriers, including
3532 the price of each item and the number of each type of item
3633 purchased.
3734 (f) Not later than December 1 of each year, the criminal
3835 justice division shall submit to the Legislative Budget Board a
3936 report that provides the following information for the preceding
4037 state fiscal year:
4138 (1) the name of each law enforcement agency that
4239 applied for a grant under this section;
4340 (2) the amount of money distributed to each law
4441 enforcement agency that received a grant under this section; and
4542 (3) as reported under Subsection (e), the number of
4643 vests, plates, and carriers purchased by each agency described by
4744 Subdivision (2).
4845 (g) The criminal justice division may use any revenue
4946 available for purposes of this section.
5047 SECTION 2. This Act takes effect immediately if it receives
5148 a vote of two-thirds of all the members elected to each house, as
5249 provided by Section 39, Article III, Texas Constitution. If this
5350 Act does not receive the vote necessary for immediate effect, this
5451 Act takes effect September 1, 2017.
