77 relating to suits against The University of Texas at Tyler.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 76.04, Education Code, is amended to
1010 read as follows:
1111 Sec. 76.04. [SUITS;] VENUE[; CITATION]. [The board may sue
1212 and be sued in the name of the institution.] Venue for a suit
1313 against the university is in Smith or Travis County. [The
1414 institution may be impleaded by service of citation on its
1515 president, and legislative consent to suits against the institution
1616 is granted.]
1717 SECTION 2. The changes in law made by this Act apply only to
1818 a cause of action that accrues on or after the effective date of
1919 this Act. A cause of action that accrues before the effective date
2020 of this Act is governed by the law in effect at that time, and that
2121 law is continued in effect for that purpose.
2222 SECTION 3. This Act takes effect immediately if it receives
2323 the vote of two-thirds of all the members elected to each house, as
2424 provided by Section 39, Article III, Texas Constitution. If this
2525 Act does not receive the vote necessary for immediate effect, this
2626 Act takes effect September 1, 2017.
