| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 76.04, Education Code, is amended to |
|---|
| 10 | 10 | | read as follows: |
|---|
| 11 | 11 | | Sec. 76.04. [SUITS;] VENUE[; CITATION]. [The board may sue |
|---|
| 12 | 12 | | and be sued in the name of the institution.] Venue for a suit |
|---|
| 13 | 13 | | against the university is in Smith or Travis County. [The |
|---|
| 14 | 14 | | institution may be impleaded by service of citation on its |
|---|
| 15 | 15 | | president, and legislative consent to suits against the institution |
|---|
| 16 | 16 | | is granted.] |

| 17 | 17 | | SECTION 2. The changes in law made by this Act apply only to |
|---|
| 18 | 18 | | a cause of action that accrues on or after the effective date of |
|---|
| 19 | 19 | | this Act. A cause of action that accrues before the effective date |
|---|
| 20 | 20 | | of this Act is governed by the law in effect at that time, and that |
|---|
| 21 | 21 | | law is continued in effect for that purpose. |

| 22 | 22 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 23 | 23 | | the vote of two-thirds of all the members elected to each house, as |
|---|
| 24 | 24 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 25 | 25 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 26 | 26 | | Act takes effect September 1, 2017. |
