55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to making a voluntary contribution to the Ending
88 Homelessness fund when registering a motor vehicle or renewing a
99 motor vehicle registration.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter H, Chapter 502, Transportation Code,
1212 is amended by adding Section 502.414 to read as follows:
1313 Sec. 502.414. VOLUNTARY CONTRIBUTION TO ENDING
1414 HOMELESSNESS FUND. (a) When a person registers or renews the
1515 registration of a motor vehicle under this chapter, the person may
1616 contribute any amount to the Ending Homelessness fund under
1717 Subsection (f).
1818 (b) The department shall provide, in a conspicuous manner,
1919 an opportunity to contribute to the Ending Homelessness fund in any
2020 registration renewal system used by the department.
2121 (c) If a person makes a contribution under this section and
2222 does not pay the full amount of a registration fee, the county
2323 assessor-collector may credit all or a portion of the contribution
2424 to the person's registration fee.
2525 (d) The county assessor-collector shall send any
2626 contribution made under this section to the comptroller for deposit
2727 to the Ending Homelessness fund before the 31st day after the date
2828 the contribution is made.
2929 (e) The department shall consult with the Texas Department
3030 of Housing and Community Affairs in performing the department's
3131 duties under this section.
3232 (f) The Ending Homelessness fund is created as a trust fund
3333 outside the state treasury to be held by the comptroller and
3434 administered by the Texas Department of Housing and Community
3535 Affairs as trustee. The fund is composed of money deposited to the
3636 credit of the fund under this section. Money in the fund shall be
3737 used to provide grants to counties and municipalities to combat
3838 homelessness.
3939 (g) The Texas Department of Housing and Community Affairs
4040 shall adopt rules governing application for grants from the Ending
4141 Homelessness fund and the issuance of those grants.
4242 SECTION 2. This Act takes effect September 1, 2017.
