| 8 | 8 | | Homelessness fund when registering a motor vehicle or renewing a |

| 9 | 9 | | motor vehicle registration. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter H, Chapter 502, Transportation Code, |
|---|
| 12 | 12 | | is amended by adding Section 502.414 to read as follows: |
|---|
| 13 | 13 | | Sec. 502.414. VOLUNTARY CONTRIBUTION TO ENDING |
|---|
| 14 | 14 | | HOMELESSNESS FUND. (a) When a person registers or renews the |
|---|
| 15 | 15 | | registration of a motor vehicle under this chapter, the person may |
|---|
| 16 | 16 | | contribute any amount to the Ending Homelessness fund under |
|---|
| 17 | 17 | | Subsection (f). |
|---|
| 18 | 18 | | (b) The department shall provide, in a conspicuous manner, |
|---|
| 19 | 19 | | an opportunity to contribute to the Ending Homelessness fund in any |
|---|
| 20 | 20 | | registration renewal system used by the department. |
|---|
| 21 | 21 | | (c) If a person makes a contribution under this section and |
|---|
| 22 | 22 | | does not pay the full amount of a registration fee, the county |
|---|
| 23 | 23 | | assessor-collector may credit all or a portion of the contribution |
|---|
| 24 | 24 | | to the person's registration fee. |
|---|
| 25 | 25 | | (d) The county assessor-collector shall send any |
|---|
| 26 | 26 | | contribution made under this section to the comptroller for deposit |
|---|
| 27 | 27 | | to the Ending Homelessness fund before the 31st day after the date |
|---|
| 28 | 28 | | the contribution is made. |
|---|
| 29 | 29 | | (e) The department shall consult with the Texas Department |
|---|
| 30 | 30 | | of Housing and Community Affairs in performing the department's |
|---|
| 31 | 31 | | duties under this section. |
|---|
| 32 | 32 | | (f) The Ending Homelessness fund is created as a trust fund |
|---|
| 33 | 33 | | outside the state treasury to be held by the comptroller and |
|---|
| 34 | 34 | | administered by the Texas Department of Housing and Community |
|---|
| 35 | 35 | | Affairs as trustee. The fund is composed of money deposited to the |
|---|
| 36 | 36 | | credit of the fund under this section. Money in the fund shall be |
|---|
| 37 | 37 | | used to provide grants to counties and municipalities to combat |
|---|
| 38 | 38 | | homelessness. |
|---|
| 39 | 39 | | (g) The Texas Department of Housing and Community Affairs |
|---|
| 40 | 40 | | shall adopt rules governing application for grants from the Ending |
|---|
| 41 | 41 | | Homelessness fund and the issuance of those grants. |
|---|
| 42 | 42 | | SECTION 2. This Act takes effect September 1, 2017. |
