104 A BILL TO BE ENTITLED
115 AN ACT
126 relating to educator preparation programs.
137 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
148 SECTION 1. Section 21.045, Education Code, is amended by
159 amending Subsection (a) and adding Subsections (a-1), (a-2), (d),
1610 and (e) to read as follows:
1711 (a) The board shall propose rules necessary to establish
1812 standards to govern the continuing accountability of all educator
1913 preparation programs based on the following information that is
2014 disaggregated with respect to race, sex, and ethnicity:
2115 (1) except as provided by Subsections (a-1) and (a-2),
2216 results of the certification examinations prescribed under Section
2317 21.048(a) and required for certification in a subject area in which
2418 a candidate has completed or is completing student teaching or an
2519 internship or practicum;
2620 (2) performance based on the appraisal system for
2721 beginning teachers adopted by the board;
2822 (3) achievement, including improvement in
2923 achievement, of students taught by beginning teachers for the first
3024 three years following certification, to the extent practicable;
3125 (4) compliance with board requirements regarding the
3226 frequency, duration, and quality of structural guidance and ongoing
3327 support provided by field supervisors to candidates completing
3428 student teaching, clinical teaching, or an internship, provided
3529 that the board:
3630 (A) must permit a program to comply with at least
37- three of any field supervisor visit requirements through visits
38- provided by video, the Internet, or another remote technological
39- method if the program also provides at least two in-person visits;
40- and
41- (B) may not require more than five support visits
42- by a field supervisor during the course of an internship; and
31+ three of any field supervisor visit requirements for a candidate
32+ for certification as a classroom teacher through visits provided by
33+ video, the Internet, or another remote technological method if the
34+ program also provides at least two in-person visits; and
35+ (B) for a candidate for certification as a
36+ classroom teacher, may not require more than five support visits by
37+ a field supervisor during the course of an internship; and
4338 (5) results from a teacher satisfaction survey,
4439 developed by the board with stakeholder input, of new teachers
4540 performed at the end of the teacher's first year of teaching.
4641 (a-1) At least two unsuccessful attempts by a candidate to
4742 perform satisfactorily on a content examination required for
4843 certification in a subject area in which the candidate serves as a
4944 teacher of record must be excluded for purposes of Subsection
5045 (a)(1) if the subject area is determined by the agency, based on
5146 information maintained by the agency and subject to approval by the
5247 United States Department of Education, to be a teacher shortage
5348 area.
5449 (a-2) At least one unsuccessful attempt by a candidate to
5550 perform satisfactorily on a content examination required for
5651 certification in a subject area in which the candidate serves as a
5752 teacher of record must be excluded for purposes of Subsection
5853 (a)(1) if the subject area is not determined to be a teacher
5954 shortage area as described by Subsection (a-1).
6055 (d) Subject to Subsection (e), a video or audio recording of
6156 a classroom recorded for purposes of a field supervisor visit
6257 described by Subsection (a)(4)(A) is confidential, may only be used
6358 for teacher training by an educator preparation program, and may
6459 only be viewed by the candidate recorded, a school district
6560 employee with a supervisory role with respect to the candidate, an
6661 employee of the educator preparation program, or another person
6762 authorized by law.
6863 (e) Subsection (d) does not limit the access of a student's
6964 parent to a record regarding the student under the Family
7065 Educational Rights and Privacy Act of 1974 (20 U.S.C. Section
7166 1232g) or other law.
7267 SECTION 2. Section 21.051(b), Education Code, is amended to
7368 read as follows:
7469 (b) Before a school district may employ a candidate for
7570 certification as a teacher of record, the candidate must complete
7671 at least 15 hours of field-based experience, which may occur after
7772 the candidate's admission to an educator preparation program or
7873 during the two years preceding admission. The candidate may
7974 satisfy the experience requirement through serving as a substitute
8075 teacher or teacher's aide for at least five school days or through
8176 other experience requiring the candidate's active engagement in
8277 instructional or educational activities. The experience must be
8378 obtained [in which the candidate is actively engaged in
8479 instructional or educational activities under supervision] at:
8580 (1) a public school campus accredited or approved for
8681 the purpose by the agency; or
8782 (2) a private school recognized or approved for the
8883 purpose by the agency.
8984 SECTION 3. Section 26.009(b), Education Code, is amended to
9085 read as follows:
9186 (b) An employee of a school district is not required to
9287 obtain the consent of a child's parent before the employee may make
9388 a videotape of a child or authorize the recording of a child's voice
9489 if the videotape or voice recording is to be used only for:
9590 (1) purposes of safety, including the maintenance of
9691 order and discipline in common areas of the school or on school
9792 buses;
9893 (2) a purpose related to a cocurricular or
9994 extracurricular activity;
10095 (3) a purpose related to regular classroom
10196 instruction;
10297 (4) media coverage of the school; [or]
10398 (5) a purpose related to the promotion of student
10499 safety under Section 29.022; or
105100 (6) a purpose related to the provision of support to a
106101 beginning teacher by a field supervisor under Section 21.045.
107102 SECTION 4. This Act takes effect only if a specific
108103 appropriation for the Act is provided in a general appropriations
109104 act of the 85th Legislature. Any portion of this Act that does not
110105 require a specific appropriation for implementation takes effect
111106 immediately, provided that this Act receives the vote necessary for
112107 immediate effect.
113108 SECTION 5. Subject to Section 4 of this Act, this Act takes
114109 effect immediately if it receives a vote of two-thirds of all the
115110 members elected to each house, as provided by Section 39, Article
116111 III, Texas Constitution. If this Act does not receive the vote
117112 necessary for immediate effect, this Act takes effect September 1,
118113 2017.
