| 12 | 7 | | certain school district planning and decision-making committees. |

| 13 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 9 | | SECTION 1. Section 11.251, Education Code, is amended by |
|---|
| 15 | 10 | | amending Subsection (e) and adding Subsection (e-1) to read as |
|---|
| 16 | 11 | | follows: |
|---|
| 17 | 12 | | (e) The board shall adopt a procedure, consistent with |
|---|
| 18 | 13 | | Subsection (e-1) and Section 21.407(a), for the professional staff |
|---|
| 19 | 14 | | in the district to nominate and elect the professional staff |
|---|
| 20 | 15 | | representatives who shall meet with the board or the board designee |
|---|
| 21 | 16 | | as required under this section. At least two-thirds of the elected |
|---|
| 22 | 17 | | professional staff representatives must be classroom teachers. The |
|---|
| 23 | 18 | | remaining staff representatives shall include both campus- and |
|---|
| 24 | 19 | | district-level professional staff members. If practicable, the |
|---|
| 25 | 20 | | committee membership shall include at least one professional staff |
|---|
| 26 | 21 | | representative with the primary responsibility for educating |
|---|
| 27 | 22 | | students with disabilities. Board policy must provide procedures |
|---|
| 28 | 23 | | for: |
|---|
| 29 | 24 | | (1) the selection of parents to the district-level and |
|---|
| 30 | 25 | | campus-level committees; and |
|---|
| 31 | 26 | | (2) the selection of community members and business |
|---|
| 32 | 27 | | representatives to serve on the district-level committee in a |
|---|
| 33 | 28 | | manner that provides for appropriate representation of the |
|---|
| 34 | 29 | | community's diversity. |
|---|
| 35 | 30 | | (e-1) The procedure for the election of professional staff |
|---|
| 36 | 31 | | representatives to a campus-level or district-level committee |
|---|
| 37 | 32 | | under Subsection (e): |
|---|
| 38 | 33 | | (1) must provide for appropriate and inclusive |
|---|
| 39 | 34 | | representation of the district's professional staff; and |
|---|
| 40 | 35 | | (2) may not limit eligibility for election to members |
|---|
| 41 | 36 | | of a single professional association or organization. |
|---|
| 42 | 37 | | SECTION 2. This Act applies beginning with the 2017-2018 |
|---|
| 43 | 38 | | school year. |
|---|
| 44 | 39 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 45 | 40 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 46 | 41 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 47 | 42 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 48 | 43 | | Act takes effect September 1, 2017. |
