94 A BILL TO BE ENTITLED
105 AN ACT
116 relating to election of professional staff representatives to
127 certain school district planning and decision-making committees.
138 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
149 SECTION 1. Section 11.251, Education Code, is amended by
1510 amending Subsection (e) and adding Subsection (e-1) to read as
1611 follows:
1712 (e) The board shall adopt a procedure, consistent with
1813 Subsection (e-1) and Section 21.407(a), for the professional staff
1914 in the district to nominate and elect the professional staff
2015 representatives who shall meet with the board or the board designee
2116 as required under this section. At least two-thirds of the elected
2217 professional staff representatives must be classroom teachers. The
2318 remaining staff representatives shall include both campus- and
2419 district-level professional staff members. If practicable, the
2520 committee membership shall include at least one professional staff
2621 representative with the primary responsibility for educating
2722 students with disabilities. Board policy must provide procedures
2823 for:
2924 (1) the selection of parents to the district-level and
3025 campus-level committees; and
3126 (2) the selection of community members and business
3227 representatives to serve on the district-level committee in a
3328 manner that provides for appropriate representation of the
3429 community's diversity.
3530 (e-1) The procedure for the election of professional staff
3631 representatives to a campus-level or district-level committee
3732 under Subsection (e):
3833 (1) must provide for appropriate and inclusive
3934 representation of the district's professional staff; and
4035 (2) may not limit eligibility for election to members
4136 of a single professional association or organization.
4237 SECTION 2. This Act applies beginning with the 2017-2018
4338 school year.
4439 SECTION 3. This Act takes effect immediately if it receives
4540 a vote of two-thirds of all the members elected to each house, as
4641 provided by Section 39, Article III, Texas Constitution. If this
4742 Act does not receive the vote necessary for immediate effect, this
4843 Act takes effect September 1, 2017.
