66 AN ACT
77 relating to the eligibility for and emergency suspension of a
88 license relating to massage therapy.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 455.1525, Occupations Code, is amended
1111 by adding Subsection (c) to read as follows:
1212 (c) An applicant is not eligible for a license under this
1313 chapter if the applicant has been finally convicted of an offense
1414 involving family violence, as defined by Section 71.004, Family
1515 Code.
1616 SECTION 2. Subchapter F, Chapter 455, Occupations Code, is
1717 amended by adding Section 455.255 to read as follows:
1818 Sec. 455.255. ADDITIONAL GROUNDS FOR EMERGENCY SUSPENSION.
1919 If a license holder is arrested for a sexual offense, the arrest is
2020 considered an emergency requiring immediate action to protect the
2121 public health and safety under Section 51.3511. The executive
2222 director may issue an emergency order to suspend the license of the
2323 license holder in accordance with that section.
2424 SECTION 3. The change in law made by this Act to Section
2525 455.1525, Occupations Code, applies only to an application for a
2626 license submitted on or after the effective date of this Act. An
2727 application for a license submitted before that date is governed by
2828 the law in effect on the date the application was submitted, and the
2929 former law is continued in effect for that purpose.
3030 SECTION 4. Section 455.255, Occupations Code, as added by
3131 this Act, applies only to an arrest of a license holder that occurs
3232 on or after the effective date of this Act. An arrest that occurs
3333 before the effective date of this Act is governed by the law in
3434 effect on the date of the arrest.
3535 SECTION 5. This Act takes effect September 1, 2017.
