 A BILL TO BE ENTITLED
 AN ACT
 relating to the eligibility for and emergency suspension of a
 license relating to massage therapy.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Section 455.1525, Occupations Code, is amended
 by adding Subsection (c) to read as follows:
 (c)  An applicant is not eligible for a license under this
 chapter if the applicant has been finally convicted of an offense
 involving family violence, as defined by Section 71.004, Family
 Code.
 SECTION 2.  Subchapter F, Chapter 455, Occupations Code, is
 amended by adding Section 455.255 to read as follows:
 Sec. 455.255.  ADDITIONAL GROUNDS FOR EMERGENCY SUSPENSION.
 If a license holder is arrested for a sexual offense, the arrest is
 considered an emergency requiring immediate action to protect the
 public health and safety under Section 51.3511.  The executive
 director may issue an emergency order to suspend the license of the
 license holder in accordance with that section.
 SECTION 3.  The change in law made by this Act to Section
 455.1525, Occupations Code, applies only to an application for a
 license submitted on or after the effective date of this Act.  An
 application for a license submitted before that date is governed by
 the law in effect on the date the application was submitted, and the
 former law is continued in effect for that purpose.
 SECTION 4.  Section 455.255, Occupations Code, as added by
 this Act, applies only to an arrest of a license holder that occurs
 on or after the effective date of this Act. An arrest that occurs
 before the effective date of this Act is governed by the law in
 effect on the date of the arrest.
 SECTION 5.  This Act takes effect September 1, 2017.
