| 14 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 15 | 10 | | SECTION 1. Section 261.101(e), Human Resources Code, as |
|---|
| 16 | 11 | | amended by Section 11(a), Chapter 854 (S.B. 1149), and Chapter 962 |
|---|
| 17 | 12 | | (S.B. 1630), Acts of the 84th Legislature, Regular Session, 2015, |
|---|
| 18 | 13 | | is reenacted and amended to read as follows: |
|---|
| 19 | 14 | | (e) Notwithstanding any other provision of this chapter, |
|---|
| 20 | 15 | | the powers of the office include: |
|---|
| 21 | 16 | | (1) facilities operated and services provided by the |
|---|
| 22 | 17 | | department under Subtitle C; |
|---|
| 23 | 18 | | (2) post-adjudication correctional facilities under |
|---|
| 24 | 19 | | Section 51.125, Family Code, or Section 152.0016 of this code; |
|---|
| 25 | 20 | | (3) any other residential facility in which a child |
|---|
| 26 | 21 | | adjudicated as having engaged in conduct indicating a need for |
|---|
| 27 | 22 | | supervision or delinquent conduct is placed by court order; and |
|---|
| 28 | 23 | | (4) the investigation of complaints alleging a |
|---|
| 29 | 24 | | violation of the rights of the children placed in a facility |
|---|
| 30 | 25 | | described by Subdivision (2) or (3). |
|---|
| 31 | 26 | | SECTION 2. The following provisions are repealed: |

| 32 | 27 | | (1) Section 54.04011(f), Family Code; |
|---|
| 33 | 28 | | (2) Sections 152.0016(l) and 261.101(f), Human |
|---|
| 34 | 29 | | Resources Code; and |
|---|
| 35 | 30 | | (3) Section 11(b), Chapter 854 (S.B. 1149), Acts of |
|---|
| 36 | 31 | | the 84th Legislature, Regular Session, 2015, which added Section |
|---|
| 37 | 32 | | 261.101(e), Human Resources Code. |
|---|
| 38 | 33 | | SECTION 3. This Act takes effect September 1, 2017. |
