94 A BILL TO BE ENTITLED
105 AN ACT
116 relating to the commitment of certain juveniles to local
127 post-adjudication secure correctional facilities in certain
138 counties and to the release under supervision of those juveniles.
149 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1510 SECTION 1. Section 261.101(e), Human Resources Code, as
1611 amended by Section 11(a), Chapter 854 (S.B. 1149), and Chapter 962
1712 (S.B. 1630), Acts of the 84th Legislature, Regular Session, 2015,
1813 is reenacted and amended to read as follows:
1914 (e) Notwithstanding any other provision of this chapter,
2015 the powers of the office include:
2116 (1) facilities operated and services provided by the
2217 department under Subtitle C;
2318 (2) post-adjudication correctional facilities under
2419 Section 51.125, Family Code, or Section 152.0016 of this code;
2520 (3) any other residential facility in which a child
2621 adjudicated as having engaged in conduct indicating a need for
2722 supervision or delinquent conduct is placed by court order; and
2823 (4) the investigation of complaints alleging a
2924 violation of the rights of the children placed in a facility
3025 described by Subdivision (2) or (3).
3126 SECTION 2. The following provisions are repealed:
3227 (1) Section 54.04011(f), Family Code;
3328 (2) Sections 152.0016(l) and 261.101(f), Human
3429 Resources Code; and
3530 (3) Section 11(b), Chapter 854 (S.B. 1149), Acts of
3631 the 84th Legislature, Regular Session, 2015, which added Section
3732 261.101(e), Human Resources Code.
3833 SECTION 3. This Act takes effect September 1, 2017.
