55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the definition of regular eligible student used in
88 determining the transportation allotment under the school finance
99 system for a municipal school district.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 42.155(b)(1), Education Code, is amended
1212 to read as follows:
1313 (1) "Regular eligible student" means:
1414 (A) for a system not operated by a municipal
1515 school district, a student who resides two or more miles from the
1616 student's campus of regular attendance, measured along the shortest
1717 route that may be traveled on public roads, and who is not
1818 classified as a student eligible for special education services;
1919 and
2020 (B) for a system operated by a municipal school
2121 district, a student who resides 0.01 or more miles from the
2222 student's campus of regular attendance, measured along the shortest
2323 route that may be traveled on public roads, and who is not
2424 classified as a student eligible for special education services.
2525 SECTION 2. Section 42.155(d), Education Code, is amended to
2626 read as follows:
2727 (d) A district, other than a municipal school district, or
2828 a county may apply for and on approval of the commissioner receive
2929 an additional amount of up to 10 percent of its regular
3030 transportation allotment to be used for the transportation of
3131 children living within two miles of the school they attend who would
3232 be subject to hazardous traffic conditions if they walked to
3333 school. Each board of trustees shall provide to the commissioner
3434 the definition of hazardous conditions applicable to that district
3535 and shall identify the specific hazardous areas for which the
3636 allocation is requested. A hazardous condition exists where no
3737 walkway is provided and children must walk along or cross a freeway
3838 or expressway, an underpass, an overpass or a bridge, an
3939 uncontrolled major traffic artery, an industrial or commercial
4040 area, or another comparable condition.
4141 SECTION 3. This Act takes effect September 1, 2017.
