| 9 | 9 | | system for a municipal school district. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 42.155(b)(1), Education Code, is amended |
|---|
| 12 | 12 | | to read as follows: |
|---|
| 13 | 13 | | (1) "Regular eligible student" means: |
|---|
| 14 | 14 | | (A) for a system not operated by a municipal |
|---|
| 15 | 15 | | school district, a student who resides two or more miles from the |
|---|
| 16 | 16 | | student's campus of regular attendance, measured along the shortest |
|---|
| 17 | 17 | | route that may be traveled on public roads, and who is not |
|---|
| 18 | 18 | | classified as a student eligible for special education services; |
|---|
| 19 | 19 | | and |
|---|
| 20 | 20 | | (B) for a system operated by a municipal school |
|---|
| 21 | 21 | | district, a student who resides 0.01 or more miles from the |
|---|
| 22 | 22 | | student's campus of regular attendance, measured along the shortest |
|---|
| 23 | 23 | | route that may be traveled on public roads, and who is not |
|---|
| 24 | 24 | | classified as a student eligible for special education services. |

| 25 | 25 | | SECTION 2. Section 42.155(d), Education Code, is amended to |
|---|
| 26 | 26 | | read as follows: |
|---|
| 27 | 27 | | (d) A district, other than a municipal school district, or |
|---|
| 28 | 28 | | a county may apply for and on approval of the commissioner receive |
|---|
| 29 | 29 | | an additional amount of up to 10 percent of its regular |
|---|
| 30 | 30 | | transportation allotment to be used for the transportation of |
|---|
| 31 | 31 | | children living within two miles of the school they attend who would |
|---|
| 32 | 32 | | be subject to hazardous traffic conditions if they walked to |
|---|
| 33 | 33 | | school. Each board of trustees shall provide to the commissioner |
|---|
| 34 | 34 | | the definition of hazardous conditions applicable to that district |
|---|
| 35 | 35 | | and shall identify the specific hazardous areas for which the |
|---|
| 36 | 36 | | allocation is requested. A hazardous condition exists where no |
|---|
| 37 | 37 | | walkway is provided and children must walk along or cross a freeway |
|---|
| 38 | 38 | | or expressway, an underpass, an overpass or a bridge, an |
|---|
| 39 | 39 | | uncontrolled major traffic artery, an industrial or commercial |
|---|
| 40 | 40 | | area, or another comparable condition. |

| 41 | 41 | | SECTION 3. This Act takes effect September 1, 2017. |
