A BILL TO BE ENTITLED
AN ACT
relating to Texas Department of Transportation consideration of
financially independent state highway toll projects.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter E, Chapter 222, Transportation Code,
is amended by adding Section 222.112 to read as follows:
Sec. 222.112. CONSIDERATION OF FINANCIALLY INDEPENDENT
PROJECT REQUIRED. The commission by rule shall adopt procedures to
require that, for each state highway system project proposed to be a
toll project, including a managed lane project, the department
consider financing and operating the project as financially
independent and not part of a system.
SECTION 2. This Act takes effect September 1, 2017.
