49 A BILL TO BE ENTITLED
510 AN ACT
611 relating to the offense of operating certain vehicles without a
712 license plate.
813 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
914 SECTION 1. Section 504.943, Transportation Code, is amended
1015 by amending Subsection (b) and adding Subsection (b-1) to read as
1116 follows:
1217 (b) A person commits an offense if the person operates on a
1318 public highway during a registration period a road tractor, a
1419 motorcycle, a trailer, a [or] semitrailer, or a motor vehicle
1520 equipped by the manufacturer with not more than one area to display
1621 a license plate that does not display a license plate that:
1722 (1) has been assigned by the department for the
1823 period; and
1924 (2) complies with department rules regarding the
2025 placement of license plates.
2126 (b-1) In this section, "area to display a license plate"
2227 means a feature of the exterior front or rear of a motor vehicle to
2328 which a person can fasten a license plate as required by rules
2429 regarding the placement of license plates adopted by the board
2530 under Section 504.010(c). The term does not include a feature if a
2631 person can only fasten a license plate to the feature after drilling
2732 through the exterior of the vehicle.
2833 SECTION 2. The change in law made by this Act applies only
2934 to an offense committed on or after the effective date of this Act.
3035 An offense committed before the effective date of this Act is
3136 governed by the law in effect on the date the offense was committed,
3237 and the former law is continued in effect for that purpose. For
3338 purposes of this section, an offense was committed before the
3439 effective date of this Act if any element of the offense occurred
3540 before that date.
3641 SECTION 3. This Act takes effect September 1, 2017.
