6	6	AN ACT
7	7	relating to the reimbursement of certain services provided by
8	8	respiratory care practitioners under Medicaid.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 531.0216, Government Code, is amended by
11	11	adding Subsection (g) to read as follows:
12	12	(g) The system developed and implemented under this section
13	13	must allow a physician or a health care facility, including a
14	14	hospital, to be reimbursed under Medicaid for the following
15	15	services performed by a respiratory care practitioner acting under
16	16	the delegation and supervision of a physician and acting within the
17	17	scope of the respiratory care practitioner's certification or
18	18	permit:
19	19	(1) telemedicine medical services, telehealth
20	20	services, and home telemonitoring services provided by a
21	21	respiratory care practitioner located at a distant site to a
22	22	patient located at a patient site; and
23	23	(2) services provided in support of the delivery of
24	24	telemedicine medical services, telehealth services, or home
25	25	telemonitoring services by a respiratory care practitioner located
26	26	at a patient site to a patient located at the patient site.
27	27	SECTION 2. If before implementing any provision of this Act
28	28	a state agency determines that a waiver or authorization from a
29	29	federal agency is necessary for implementation of that provision,
30	30	the agency affected by the provision shall request the waiver or
31	31	authorization and may delay implementing that provision until the
32	32	waiver or authorization is granted.
33	33	SECTION 3. This Act takes effect September 1, 2017.
