55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the reimbursement of certain services provided by
88 respiratory care practitioners under Medicaid.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 531.0216, Government Code, is amended by
1111 adding Subsection (g) to read as follows:
1212 (g) The system developed and implemented under this section
1313 must allow a physician or a health care facility, including a
1414 hospital, to be reimbursed under Medicaid for the following
1515 services performed by a respiratory care practitioner acting under
1616 the delegation and supervision of a physician and acting within the
1717 scope of the respiratory care practitioner's certification or
1818 permit:
1919 (1) telemedicine medical services, telehealth
2020 services, and home telemonitoring services provided by a
2121 respiratory care practitioner located at a distant site to a
2222 patient located at a patient site; and
2323 (2) services provided in support of the delivery of
2424 telemedicine medical services, telehealth services, or home
2525 telemonitoring services by a respiratory care practitioner located
2626 at a patient site to a patient located at the patient site.
2727 SECTION 2. If before implementing any provision of this Act
2828 a state agency determines that a waiver or authorization from a
2929 federal agency is necessary for implementation of that provision,
3030 the agency affected by the provision shall request the waiver or
3131 authorization and may delay implementing that provision until the
3232 waiver or authorization is granted.
3333 SECTION 3. This Act takes effect September 1, 2017.
