 A BILL TO BE ENTITLED
 AN ACT
 relating to the reimbursement of certain services provided by
 respiratory care practitioners under Medicaid.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Section 531.0216, Government Code, is amended by
 adding Subsection (g) to read as follows:
 (g)  The system developed and implemented under this section
 must allow a physician or a health care facility, including a
 hospital, to be reimbursed under Medicaid for the following
 services performed by a respiratory care practitioner acting under
 the delegation and supervision of a physician and acting within the
 scope of the respiratory care practitioner's certification or
 permit:
 (1)  telemedicine medical services, telehealth
 services, and home telemonitoring services provided by a
 respiratory care practitioner located at a distant site to a
 patient located at a patient site; and
 (2)  services provided in support of the delivery of
 telemedicine medical services, telehealth services, or home
 telemonitoring services by a respiratory care practitioner located
 at a patient site to a patient located at the patient site.
 SECTION 2.  If before implementing any provision of this Act
 a state agency determines that a waiver or authorization from a
 federal agency is necessary for implementation of that provision,
 the agency affected by the provision shall request the waiver or
 authorization and may delay implementing that provision until the
 waiver or authorization is granted.
 SECTION 3.  This Act takes effect September 1, 2017.
