85 AN ACT
96 relating to the eligibility of certain municipalities to establish
107 homestead preservation districts and reinvestment zones.
118 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12- SECTION 1. Section 373A.003, Local Government Code, is
13- amended by amending Subsection (a) and adding Subsection (a-1) to
14- read as follows:
15- (a) This chapter applies to:
16- (1) a municipality with a population of more than
17- 750,000 that is located in a uniform state service region with fewer
18- than 800,000 [550,000] occupied housing units as determined by the
19- most recent United States decennial census; and
20- (2) a municipality that contains more than 75 percent
21- of the population of a county with a population of 1.5 million or
22- more.
23- (a-1) If this chapter applies to a municipality as provided
24- by Subsection (a), the application of this chapter to the
25- municipality is not affected if the municipality's population or
26- the number of occupied housing units changes and the municipality
27- no longer meets the population requirement of Subsection (a).
9+ SECTION 1. Section 373A.003(a), Local Government Code, is
10+ amended to read as follows:
11+ Sec. 373A.003. APPLICABILITY OF CHAPTER. (a) This chapter
12+ applies to a municipality with a population of more than 750,000
13+ that is located in a uniform state service region with fewer than
14+ 800,000 [550,000] occupied housing units as determined by the most
15+ recent United States decennial census.
16+ (b) Subchapters A, B, C, and D apply to any municipality
17+ with a population of 1.18 million or more which is located
18+ predominantly in a county that has a total area of less than 1,000
19+ square miles and has adopted an urban land bank demonstration
20+ program under Chapter 379C, Local Government Code.
21+ (c) If this chapter applies to a municipality as provided by
22+ Subsection (a), the application of this chapter to the municipality
23+ is not affected if the municipality's population or the number of
24+ occupied housing units changes and the municipality no longer meets
25+ the population requirement of Subsection (a).
2826 SECTION 2. This Act takes effect September 1, 2017.
