12 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

13 | 9 | | SECTION 1. Section 21.351, Education Code, is amended by |

14 | 10 | | adding Subsection (e) to read as follows: |

15 | 11 | | (e) Under the recommended appraisal process, a student |
---|
16 | 12 | | evaluation may not be used as a criterion on which to appraise the |
---|
17 | 13 | | performance of a teacher. |

18 | 14 | | SECTION 2. Section 21.352, Education Code, is amended by |
---|
19 | 15 | | adding Subsection (g) to read as follows: |

20 | 16 | | (g) Under the appraisal process developed under this |
---|
21 | 17 | | section, a student evaluation may not be used as a criterion on |
---|
22 | 18 | | which to appraise the performance of a teacher. |
---|
23 | 19 | | SECTION 3. This Act applies beginning with the 2017-2018 |
---|
24 | 20 | | school year. |
---|
25 | 21 | | SECTION 4. This Act takes effect immediately if it receives |
---|
26 | 22 | | a vote of two-thirds of all the members elected to each house, as |
---|
27 | 23 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
28 | 24 | | Act does not receive the vote necessary for immediate effect, this |
---|
29 | 25 | | Act takes effect September 1, 2017. |
