55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to creation of a task force to study the health effects of
88 concrete and rock crushing.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. TASK FORCE TO STUDY CONCRETE AND ROCK CRUSHING.
1111 (a) In this Act, "task force" means the Task Force to Study the
1212 Health Effects of Concrete and Rock Crushing established under this
1313 section.
1414 (b) The Task Force to Study the Health Effects of Concrete
1515 and Rock Crushing is established for the purpose of assessing the
1616 health effects of concrete and rock crushing.
1717 (c) The task force is composed of members appointed by the
1818 governor to represent the following:
1919 (1) the Texas Commission on Environmental Quality; and
2020 (2) the Department of State Health Services.
2121 (d) The task force may seek input from:
2222 (1) the Texas Medical Association;
2323 (2) the Texas Hospital Association;
2424 (3) the American Heart Association; and
2525 (4) the American Lung Association.
2626 (e) The members of the task force shall elect a presiding
2727 officer from among the membership.
2828 (f) The offices of the governor, lieutenant governor, and
2929 speaker of the house of representatives shall provide staff support
3030 to the task force.
3131 (g) The task force shall hold public hearings to achieve the
3232 purpose described by Subsection (b) of this section.
3333 (h) A member of the task force is not entitled to receive
3434 compensation for service on the task force but is entitled to
3535 reimbursement of the travel expenses incurred by the member while
3636 conducting the business of the task force.
3737 (i) The task force may accept gifts and grants from any
3838 source to be used to carry out a function of the task force.
3939 SECTION 2. FINAL REPORT. Not later than November 1, 2018,
4040 the task force shall submit a final report to the governor, the
4141 lieutenant governor, the speaker of the house of representatives,
4242 and the appropriate standing committees of the legislature. The
4343 report shall include a summary and analysis of:
4444 (1) hearings and studies conducted by the task force;
4545 (2) legislation proposed by the task force; and
4646 (3) other findings and recommendations made by the
4747 task force.
4848 SECTION 3. APPOINTMENTS. Not later than December 1, 2017,
4949 the governor shall make the appointments to the task force as
5050 described by Section 1(c) of this Act.
5151 SECTION 4. EXPIRATION. The task force is abolished and this
5252 Act expires August 31, 2019.
5353 SECTION 5. EFFECTIVE DATE. This Act takes effect
5454 immediately if it receives a vote of two-thirds of all the members
5555 elected to each house, as provided by Section 39, Article III, Texas
5656 Constitution. If this Act does not receive the vote necessary for
5757 immediate effect, this Act takes effect September 1, 2017.
