5	7		relating to granting road powers to the Montgomery County Municipal
6	8		Utility District No. 100; providing authority to issue bonds.
7	9		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	10		SECTION 1. Section 8119.002, Special District Local Laws
9	11		Code, is amended to read as follows:
10	12		Sec. 8119.002. NATURE OF DISTRICT; FINDINGS OF PUBLIC
11	13		PURPOSE AND BENEFIT. (a) The district is created to serve a public
12	14		purpose and benefit [a municipal utility district in Montgomery
13	15		County created under and essential to accomplish the purposes of
14	16		Section 59, Article XVI, Texas Constitution].
15	17		(b) The creation of the district is essential to accomplish
16	18		the purposes of:
17	19		(1) a municipal utility district as provided by
18	20		general law and Section 59, Article XVI, Texas Constitution; and
19	21		(2) Section 52, Article III, Texas Constitution, that
20	22		relate to the construction, acquisition, improvement, operation,
21	23		or maintenance of macadamized, graveled, or paved roads, or
22	24		improvements, including storm drainage, in aid of those roads.
23	25		SECTION 2. Subchapter C, Chapter 8119, Special District
24	26		Local Laws Code, is amended by adding Sections 8119.104 and
25	27		8119.105 to read as follows:
26	28		Sec. 8119.104. AUTHORITY FOR ROAD PROJECTS. Under Section
27	29		52, Article III, Texas Constitution, the district may design,
28	30		acquire, construct, finance, issue bonds for, improve, operate,
29	31		maintain, and convey to this state, a county, or a municipality for
30	32		operation and maintenance macadamized, graveled, or paved roads, or
31	33		improvements, including storm drainage, in aid of those roads.
32	34		Sec. 8119.105. ROAD STANDARDS AND REQUIREMENTS. (a) A
33	35		road project must meet all applicable construction standards,
34	36		zoning and subdivision requirements, and regulations of each
35	37		municipality in whose corporate limits or extraterritorial
36	38		jurisdiction the road project is located.
37	39		(b) If a road project is not located in the corporate limits
38	40		or extraterritorial jurisdiction of a municipality, the road
39	41		project must meet all applicable construction standards,
40	42		subdivision requirements, and regulations of each county in which
41	43		the road project is located.
42	44		(c) If the state will maintain and operate the road, the
43	45		Texas Transportation Commission must approve the plans and
44	46		specifications of the road project.
45	47		SECTION 3. Chapter 8119, Special District Local Laws Code,
46	48		is amended by adding Subchapter D to read as follows:
47	49		SUBCHAPTER D. BONDS
48	50		Sec. 8119.151. BONDS FOR ROAD PROJECTS. At the time of
49	51		issuance, the total principal amount of bonds or other obligations
50	52		issued or incurred to finance road projects and payable from ad
51	53		valorem taxes may not exceed one-fourth of the assessed value of the
52	54		real property in the district.
53	55		SECTION 4. (a) The legal notice of the intention to
54	56		introduce this Act, setting forth the general substance of this
55	57		Act, has been published as provided by law, and the notice and a
56	58		copy of this Act have been furnished to all persons, agencies,
57	59		officials, or entities to which they are required to be furnished
58	60		under Section 59, Article XVI, Texas Constitution, and Chapter 313,
59	61		Government Code.
60	62		(b) The governor, one of the required recipients, has
61	63		submitted the notice and Act to the Texas Commission on
62	64		Environmental Quality.
63	65		(c) The Texas Commission on Environmental Quality has filed
64	66		its recommendations relating to this Act with the governor, the
65	67		lieutenant governor, and the speaker of the house of
66	68		representatives within the required time.
67	69		(d) All requirements of the constitution and laws of this
68	70		state and the rules and procedures of the legislature with respect
69	71		to the notice, introduction, and passage of this Act are fulfilled
70	72		and accomplished.
71	73		SECTION 5. This Act takes effect immediately if it receives
72	74		a vote of two-thirds of all the members elected to each house, as
73	75		provided by Section 39, Article III, Texas Constitution. If this
74	76		Act does not receive the vote necessary for immediate effect, this
75	77		Act takes effect September 1, 2017.
