4	8		AN ACT
5	9		relating to the creation of Lakewood Improvement District of Harris
6	10		County; providing authority to issue bonds; providing authority to
7	11		impose assessments, fees, or taxes.
8	12		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	13		SECTION 1. Subtitle C, Title 4, Special District Local Laws
10	14		Code, is amended by adding Chapter 3951 to read as follows:
11	15		CHAPTER 3951. LAKEWOOD IMPROVEMENT DISTRICT OF HARRIS COUNTY
12	16		SUBCHAPTER A. GENERAL PROVISIONS
13	17		Sec. 3951.001. DEFINITIONS. In this chapter:
14	18		(1) "Board" means the district's board of directors.
15	19		(2) "City" means the City of Houston.
16	20		(3) "County" means Harris County.
17	21		(4) "Director" means a board member.
18	22		(5) "District" means the Lakewood Improvement
19	23		District of Harris County.
20	24		Sec. 3951.002. NATURE OF DISTRICT. The district is a
21	25		special district created under Section 59, Article XVI, Texas
22	26		Constitution.
23	27		Sec. 3951.003. PURPOSE; DECLARATION OF INTENT. (a) The
24	28		creation of the district is essential to accomplish the purposes of
25	29		Sections 52 and 52-a, Article III, and Section 59, Article XVI,
26	30		Texas Constitution, and other public purposes stated in this
27	31		chapter. By creating the district and in authorizing the city, the
28	32		county, and other political subdivisions to contract with the
29	33		district, the legislature has established a program to accomplish
30	34		the public purposes set out in Section 52-a, Article III, Texas
31	35		Constitution.
32	36		(b) The creation of the district is necessary to promote,
33	37		develop, encourage, and maintain employment, commerce,
34	38		transportation, housing, tourism, recreation, the arts,
35	39		entertainment, economic development, safety, and the public
36	40		welfare in the district, and to accomplish the redevelopment of
37	41		land in the district.
38	42		(c) This chapter and the creation of the district may not be
39	43		interpreted to relieve the city or the county from providing the
40	44		level of services provided as of the effective date of the Act
41	45		enacting this chapter to the area in the district. The district is
42	46		created to supplement and not to supplant city or county services
43	47		provided in the district.
44	48		Sec. 3951.004. FINDINGS OF BENEFIT AND PUBLIC PURPOSE.
45	49		(a) The district is created to serve a public use and benefit.
46	50		(b) All land and other property included in the district
47	51		will benefit from the improvements and services to be provided by
48	52		the district under powers conferred by Sections 52 and 52-a,
49	53		Article III, and Section 59, Article XVI, Texas Constitution, and
50	54		other powers granted under this chapter.
51	55		(c) The creation of the district is in the public interest
52	56		and is essential to further the public purposes of:
53	57		(1) developing and diversifying the economy of the
54	58		state;
55	59		(2) eliminating unemployment and underemployment; and
56	60		(3) developing or expanding transportation and
57	61		commerce.
58	62		(d) The district will:
59	63		(1) promote the health, safety, and general welfare of
60	64		residents, employers, potential employees, employees, visitors,
61	65		and consumers in the district, and of the public;
62	66		(2) provide needed funding for the district to
63	67		preserve, maintain, and enhance the economic health and vitality of
64	68		the district territory as a community and business center;
65	69		(3) promote the health, safety, welfare, and enjoyment
66	70		of the public by providing pedestrian ways, parking facilities, and
67	71		conduit facilities and by landscaping and developing certain areas
68	72		in the district, which are necessary for the restoration,
69	73		preservation, and enhancement of scenic beauty; and
70	74		(4) provide for road, bridge, and recreational
71	75		facilities for the district.
72	76		(e) Pedestrian ways along or across a street, whether at
73	77		grade or above or below the surface, and street lighting, street
74	78		landscaping, parking, and street art objects are parts of and
75	79		necessary components of a street or road and are considered to be a
76	80		street or road improvement.
77	81		(f) The district will not act as the agent or
78	82		instrumentality of any private interest even though the district
79	83		will benefit many private interests as well as the public.
80	84		Sec. 3951.005. INITIAL DISTRICT TERRITORY. (a) The
81	85		district is initially composed of the territory described by
82	86		Section 2 of the Act enacting this chapter.
83	87		(b) The boundaries and field notes contained in Section 2 of
84	88		the Act enacting this chapter form a closure. A mistake in the
85	89		field notes or in copying the field notes in the legislative process
86	90		does not affect the district's:
87	91		(1) organization, existence, or validity;
88	92		(2) right to issue any type of bonds for the purposes
89	93		for which the district is created or to pay the principal of and
90	94		interest on bonds;
91	95		(3) right to impose or collect an assessment or tax; or
92	96		(4) legality or operation.
93	97		Sec. 3951.006. ELIGIBILITY FOR INCLUSION IN SPECIAL ZONES.
94	98		All or any part of the area of the district is eligible to be
95	99		included in:
96	100		(1) a tax increment reinvestment zone created under
97	101		Chapter 311, Tax Code;
98	102		(2) a tax abatement reinvestment zone created under
99	103		Chapter 312, Tax Code;
100	104		(3) an enterprise zone created under Chapter 2303,
101	105		Government Code; or
102	106		(4) an industrial district created under Chapter 42,
103	107		Local Government Code.
104	108		Sec. 3951.007. APPLICABILITY OF MUNICIPAL MANAGEMENT
105	109		DISTRICTS LAW. Except as otherwise provided by this chapter,
106	110		Chapter 375, Local Government Code, applies to the district.
107	111		Sec. 3951.008. CONSTRUCTION OF CHAPTER. This chapter shall
108	112		be liberally construed in conformity with the findings and purposes
109	113		stated in this chapter.
110	114		SUBCHAPTER B. BOARD OF DIRECTORS
111	115		Sec. 3951.051. GOVERNING BODY; TERMS. (a) The district is
112	116		governed by a board of five voting directors who serve staggered
113	117		terms of four years, with two or three directors' terms expiring
114	118		June 1 of each odd-numbered year.
115	119		(b) The board by resolution may change the number of voting
116	120		directors on the board if the board determines that the change is in
117	121		the best interest of the district. The board may not consist of
118	122		fewer than five or more than nine voting directors.
119	123		Sec. 3951.052. APPOINTMENT OF VOTING DIRECTORS. The Texas
120	124		Commission on Environmental Quality shall appoint voting directors
121	125		from persons recommended by the board.
122	126		Sec. 3951.053. NONVOTING DIRECTORS. The board may appoint
123	127		nonvoting directors to serve at the pleasure of the voting
124	128		directors.
125	129		Sec. 3951.054. QUORUM. For purposes of determining the
126	130		requirements for a quorum of the board, the following are not
127	131		counted:
128	132		(1) a board position vacant for any reason, including
129	133		death, resignation, or disqualification;
130	134		(2) a director who is abstaining from participation in
131	135		a vote because of a conflict of interest; or
132	136		(3) a nonvoting director.
133	137		Sec. 3951.055. COMPENSATION. A director is entitled to
134	138		receive fees of office and reimbursement for actual expenses as
135	139		provided by Section 49.060, Water Code. Sections 375.069 and
136	140		375.070, Local Government Code, do not apply to the board.
137	141		Sec. 3951.056. INITIAL VOTING DIRECTORS. (a) The initial
138	142		board consists of:

157	161		SUBCHAPTER C. POWERS AND DUTIES
158	162		Sec. 3951.101. GENERAL POWERS AND DUTIES. The district has
159	163		the powers and duties necessary to accomplish the purposes for
160	164		which the district is created.
161	165		Sec. 3951.102. IMPROVEMENT PROJECTS AND SERVICES. The
162	166		district may provide, design, construct, acquire, improve,
163	167		relocate, operate, maintain, or finance an improvement project or
164	168		service using any money available to the district, or contract with
165	169		a governmental or private entity to provide, design, construct,
166	170		acquire, improve, relocate, operate, maintain, or finance an
167	171		improvement project or service authorized under this chapter or
168	172		Chapter 375, Local Government Code.
169	173		Sec. 3951.103. DEVELOPMENT CORPORATION POWERS. The
170	174		district, using money available to the district, may exercise the
171	175		powers given to a development corporation under Chapter 505, Local
172	176		Government Code, including the power to own, operate, acquire,
173	177		construct, lease, improve, or maintain a project under that
174	178		chapter.
175	179		Sec. 3951.104. NONPROFIT CORPORATION. (a) The board by
176	180		resolution may authorize the creation of a nonprofit corporation to
177	181		assist and act for the district in implementing a project or
178	182		providing a service authorized by this chapter.
179	183		(b) The nonprofit corporation:
180	184		(1) has each power of and is considered to be a local
181	185		government corporation created under Subchapter D, Chapter 431,
182	186		Transportation Code; and
183	187		(2) may implement any project and provide any service
184	188		authorized by this chapter.
185	189		(c) The board shall appoint the board of directors of the
186	190		nonprofit corporation. The board of directors of the nonprofit
187	191		corporation shall serve in the same manner as the board of directors
188	192		of a local government corporation created under Subchapter D,
189	193		Chapter 431, Transportation Code, except that a board member is not
190	194		required to reside in the district.
191	195		Sec. 3951.105. AGREEMENTS; GRANTS. (a) As provided by
192	196		Chapter 375, Local Government Code, the district may make an
193	197		agreement with or accept a gift, grant, or loan from any person.
194	198		(b) The implementation of a project is a governmental
195	199		function or service for the purposes of Chapter 791, Government
196	200		Code.
197	201		Sec. 3951.106. LAW ENFORCEMENT SERVICES. To protect the
198	202		public interest, the district may contract with a qualified party,
199	203		including the county or the city, to provide law enforcement
200	204		services in the district for a fee.
201	205		Sec. 3951.107. MEMBERSHIP IN CHARITABLE ORGANIZATIONS. The
202	206		district may join and pay dues to a charitable or nonprofit
203	207		organization that performs a service or provides an activity
204	208		consistent with the furtherance of a district purpose.
205	209		Sec. 3951.108. ECONOMIC DEVELOPMENT. (a) The district may
206	210		engage in activities that accomplish the economic development
207	211		purposes of the district.
208	212		(b) The district may establish and provide for the
209	213		administration of one or more programs to promote state or local
210	214		economic development and to stimulate business and commercial
211	215		activity in the district, including programs to:
212	216		(1) make loans and grants of public money; and
213	217		(2) provide district personnel and services.
214	218		(c) The district may create economic development programs
215	219		and exercise the economic development powers provided to
216	220		municipalities by:
217	221		(1) Chapter 380, Local Government Code; and
218	222		(2) Subchapter A, Chapter 1509, Government Code.
219	223		Sec. 3951.109. PARKING FACILITIES. (a) The district may
220	224		acquire, lease as lessor or lessee, construct, develop, own,
221	225		operate, and maintain parking facilities or a system of parking
222	226		facilities, including lots, garages, parking terminals, or other
223	227		structures or accommodations for parking motor vehicles off the
224	228		streets and related appurtenances.
225	229		(b) The district's parking facilities serve the public
226	230		purposes of the district and are owned, used, and held for a public
227	231		purpose even if leased or operated by a private entity for a term of
228	232		years.
229	233		(c) The district's parking facilities are parts of and
230	234		necessary components of a street and are considered to be a street
231	235		or road improvement.
232	236		(d) The development and operation of the district's parking
233	237		facilities may be considered an economic development program.
234	238		Sec. 3951.110. ANNEXATION AND EXCLUSION OF LAND. (a) The
235	239		district may annex land as provided by Subchapter J, Chapter 49,
236	240		Water Code.
237	241		(b) The district may exclude land as provided by Subchapter
238	242		J, Chapter 49, Water Code. Section 375.044(b), Local Government
239	243		Code, does not apply to the district.
240	244		Sec. 3951.111. NAVIGATION DISTRICT POWERS. (a) The
241	245		district has the powers provided by the general law of this state
242	246		applicable to navigation districts created under Section 59,
243	247		Article XVI, Texas Constitution, including Chapters 60 and 62,
244	248		Water Code.
245	249		(b) The district may purchase, construct, acquire, own,
246	250		operate, maintain, improve, or extend, inside and outside the
247	251		district, a canal, waterway, bulkhead, dock, or other improvement
248	252		or facility necessary or convenient to accomplish the navigation
249	253		purposes of the district.
250	254		Sec. 3951.112. ROAD DISTRICT POWERS. The district has the
251	255		powers provided by the general laws relating to road districts and
252	256		road utility districts created under Section 52(b), Article III,
253	257		Texas Constitution, including Chapters 257 and 441, Transportation
254	258		Code.
255	259		Sec. 3951.113. ROAD STANDARDS AND REQUIREMENTS. (a) A
256	260		road project must meet all applicable construction standards,
257	261		zoning and subdivision requirements, and regulations of each
258	262		municipality in whose corporate limits or extraterritorial
259	263		jurisdiction the road project is located.
260	264		(b) If a road project is not located in the corporate limits
261	265		or extraterritorial jurisdiction of a municipality, the road
262	266		project must meet all applicable construction standards,
263	267		subdivision requirements, and regulations of each county in which
264	268		the road project is located.
265	269		(c) If the state will maintain and operate the road, the
266	270		Texas Transportation Commission must approve the plans and
267	271		specifications of the road project.
268	272		Sec. 3951.114. PROPERTY OF CERTAIN UTILITIES EXEMPT FROM
269	273		ASSESSMENTS AND FEES. The district may not impose an assessment,
270	274		impact fee, or standby fee on the property, including the
271	275		equipment, rights-of-way, easements, facilities, or improvements,
272	276		of:
273	277		(1) an electric utility or a power generation company
274	278		as defined by Section 31.002, Utilities Code;
275	279		(2) a gas utility, as defined by Section 101.003 or
276	280		121.001, Utilities Code, or a person who owns pipelines used for the
277	281		transportation or sale of oil or gas or a product or constituent of
278	282		oil or gas;
279	283		(3) a person who owns pipelines used for the
280	284		transportation or sale of carbon dioxide;
281	285		(4) a telecommunications provider as defined by
282	286		Section 51.002, Utilities Code; or
283	287		(5) a cable service provider or video service provider
284	288		as defined by Section 66.002, Utilities Code.
285	289		Sec. 3951.115. USE OF ELECTRICAL OR OPTICAL LINES.
286	290		(a) The district may impose an assessment to pay the cost of:
287	291		(1) burying or removing electrical power lines,
288	292		telephone lines, cable or fiber-optic lines, or any other type of
289	293		electrical or optical line; and
290	294		(2) removing poles and any elevated lines using the
291	295		poles.
292	296		(b) The district may finance, acquire, construct, improve,
293	297		operate, maintain, or charge fees for the use of the district
294	298		conduits for another person's:
295	299		(1) telecommunications network; or
296	300		(2) fiber-optic cable.
297	301		(c) Consistent with Title 2, Utilities Code, the district
298	302		may finance, construct, or maintain conduits for:
299	303		(1) electronic transmission and distribution lines
300	304		and supporting facilities; or
301	305		(2) other types of transmission and distribution lines
302	306		and supporting facilities.
303	307		(d) The district may not require a person to use a district
304	308		conduit.
305	309		Sec. 3951.116. NO EMINENT DOMAIN POWER. The district may
306	310		not exercise the power of eminent domain.
307	311		SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS; ASSESSMENTS
308	312		Sec. 3951.151. DISBURSEMENTS AND TRANSFERS OF MONEY. The
309	313		board by resolution shall establish the number of directors'
310	314		signatures and the procedure required for a disbursement or
311	315		transfer of district money.
312	316		Sec. 3951.152. MONEY USED FOR IMPROVEMENTS OR SERVICES.
313	317		The district may acquire, construct, finance, operate, or maintain
314	318		any improvement or service authorized under this chapter or Chapter
315	319		375, Local Government Code, using any money available to the
316	320		district.
317	321		Sec. 3951.153. PETITION REQUIRED FOR FINANCING SERVICES AND
318	322		IMPROVEMENTS WITH ASSESSMENTS. (a) The board may not finance a
319	323		service or improvement project with assessments under this chapter
320	324		unless a written petition requesting that service or improvement
321	325		has been filed with the board.
322	326		(b) A petition filed under Subsection (a) must be signed by
323	327		the owners of a majority of the assessed value of real property in
324	328		the district subject to assessment according to the most recent
325	329		certified tax appraisal roll for the county.
326	330		Sec. 3951.154. ASSESSMENTS; LIENS FOR ASSESSMENTS.
327	331		(a) The board by resolution may impose and collect an assessment
328	332		for any purpose authorized by this chapter in all or any part of the
329	333		district.
330	334		(b) An assessment, a reassessment, or an assessment
331	335		resulting from an addition to or correction of the assessment roll
332	336		by the district, penalties and interest on an assessment or
333	337		reassessment, an expense of collection, and reasonable attorney's
334	338		fees incurred by the district:
335	339		(1) are a first and prior lien against the property
336	340		assessed;
337	341		(2) are superior to any other lien or claim other than
338	342		a lien or claim for county, school district, or municipal ad valorem
339	343		taxes; and
340	344		(3) are the personal liability of and a charge against
341	345		the owners of the property even if the owners are not named in the
342	346		assessment proceedings.
343	347		(c) The lien is effective from the date of the board's
344	348		resolution imposing the assessment until the date the assessment is
345	349		paid. The board may enforce the lien in the same manner that the
346	350		board may enforce an ad valorem tax lien against real property.
347	351		(d) The board may make a correction to or deletion from the
348	352		assessment roll that does not increase the amount of assessment of
349	353		any parcel of land without providing notice and holding a hearing in
350	354		the manner required for additional assessments.
351	355		Sec. 3951.155. TAX AND ASSESSMENT ABATEMENTS. The district
352	356		may designate reinvestment zones and may grant abatements of a tax
353	357		or assessment on property in the zones.
354	358		Sec. 3951.156. RESIDENTIAL PROPERTY NOT EXEMPT. Section
355	359		375.161, Local Government Code, does not apply to the district.
356	360		Sec. 3951.157. COMPETITIVE BIDDING. Subchapter I, Chapter
357	361		49, Water Code, applies to the district. Sections 375.221 and
358	362		375.223, Local Government Code, do not apply to the district.
359	363		SUBCHAPTER E. TAXES AND BONDS
360	364		Sec. 3951.201. ELECTIONS REGARDING TAXES AND BONDS.
361	365		(a) The district may issue, without an election, bonds, notes, and
362	366		other obligations secured by:
363	367		(1) revenue other than ad valorem taxes; or
364	368		(2) contract payments described by Section 3951.203.
365	369		(b) The district must hold an election in the manner
366	370		provided by Subchapter L, Chapter 375, Local Government Code, to
367	371		obtain voter approval before the district may impose an ad valorem
368	372		tax or issue bonds payable from ad valorem taxes.
369	373		(c) Section 375.243, Local Government Code, does not apply
370	374		to the district.
371	375		(d) All or any part of any facilities or improvements that
372	376		may be acquired by a district by the issuance of its bonds may be
373	377		submitted as a single proposition or as several propositions to be
374	378		voted on at the election.
375	379		Sec. 3951.202. OPERATION AND MAINTENANCE TAX. (a) If
376	380		authorized by a majority of the district voters voting at an
377	381		election held in accordance with Section 3951.201, the district may
378	382		impose an operation and maintenance tax on taxable property in the
379	383		district in accordance with Section 49.107, Water Code, for any
380	384		district purpose, including to:
381	385		(1) maintain and operate the district;
382	386		(2) construct or acquire improvements; or
383	387		(3) provide a service.
384	388		(b) The board shall determine the tax rate. The rate may not
385	389		exceed the rate approved at the election.
386	390		(c) Section 49.107(h), Water Code, does not apply to the
387	391		district.
388	392		Sec. 3951.203. CONTRACT TAXES. (a) In accordance with
389	393		Section 49.108, Water Code, the district may impose a tax other than
390	394		an operation and maintenance tax and use the revenue derived from
391	395		the tax to make payments under a contract after the provisions of
392	396		the contract have been approved by a majority of the district voters
393	397		voting at an election held for that purpose.
394	398		(b) A contract approved by the district voters may contain a
395	399		provision stating that the contract may be modified or amended by
396	400		the board without further voter approval.
397	401		Sec. 3951.204. AUTHORITY TO BORROW MONEY AND TO ISSUE BONDS
398	402		AND OTHER OBLIGATIONS. (a) The district may borrow money on terms
399	403		determined by the board. Section 375.205, Local Government Code,
400	404		does not apply to a loan, line of credit, or other borrowing from a
401	405		bank or financial institution secured by revenue other than ad
402	406		valorem taxes.
403	407		(b) The district may issue bonds, notes, or other
404	408		obligations payable wholly or partly from ad valorem taxes,
405	409		assessments, impact fees, revenue, contract payments, grants, or
406	410		other district money, or any combination of those sources of money,
407	411		to pay for any authorized district purpose.
408	412		(c) The limitation on the outstanding principal amount of
409	413		bonds, notes, and other obligations provided by Section 49.4645,
410	414		Water Code, does not apply to the district.
411	415		Sec. 3951.205. TAXES FOR BONDS. At the time the district
412	416		issues bonds payable wholly or partly from ad valorem taxes, the
413	417		board shall provide for the annual imposition of a continuing
414	418		direct annual ad valorem tax, without limit as to rate or amount,
415	419		for each year that all or part of the bonds are outstanding as
416	420		required and in the manner provided by Sections 54.601 and 54.602,
417	421		Water Code.
418	422		Sec. 3951.206. BONDS FOR ROAD PROJECTS. At the time of
419	423		issuance, the total principal amount of bonds or other obligations
420	424		issued or incurred to finance road projects and payable from ad
421	425		valorem taxes may not exceed one-fourth of the assessed value of the
422	426		real property in the district.
423	427		SUBCHAPTER F. SALES AND USE TAX
424	428		Sec. 3951.251. MEANINGS OF WORDS AND PHRASES. A word or
425	429		phrase used in this subchapter that is defined by Chapter 151 or
426	430		321, Tax Code, has the meaning assigned by Chapter 151 or 321, Tax
427	431		Code.
428	432		Sec. 3951.252. APPLICABILITY OF CERTAIN TAX CODE
429	433		PROVISIONS. (a) The provisions of Subchapters C, D, E, and F,
430	434		Chapter 323, Tax Code, relating to county sales and use taxes apply
431	435		to the application, collection, and administration of a sales and
432	436		use tax imposed under this subchapter to the extent consistent with
433	437		this chapter, as if references in Chapter 323, Tax Code, to a county
434	438		referred to the district and references to a commissioners court
435	439		referred to the board.
436	440		(b) Sections 323.401-323.404 and 323.505, Tax Code, do not
437	441		apply to a tax imposed under this subchapter.
438	442		Sec. 3951.253. AUTHORIZATION; ELECTION. (a) The district
439	443		shall adopt, reduce, or repeal the sales and use tax authorized by
440	444		this subchapter at an election in which a majority of the voters of
441	445		the district voting in the election approve the adoption,
442	446		reduction, or repeal of the tax, as applicable.
443	447		(b) The board by order shall call an election to adopt,
444	448		reduce, or repeal a sales and use tax. The election shall be held on
445	449		the first authorized uniform election date that occurs after the
446	450		time required by Section 3.005, Election Code.
447	451		(c) The district shall provide notice of the election and
448	452		shall hold the election in the manner prescribed by Chapter 54,
449	453		Water Code, for bond elections for municipal utility districts.
450	454		(d) The ballots shall be printed to provide for voting for
451	455		or against the following appropriate proposition:
452	456		(1) "Adoption of a ___ percent district sales and use
453	457		tax in the district";
454	458		(2) "Reduction of the district sales and use tax in the
455	459		district from ___ percent to ___ percent"; or
456	460		(3) "Repeal of the district sales and use tax in the
457	461		district."
458	462		Sec. 3951.254. EFFECTIVE DATE OF TAX. A tax imposed under
459	463		this subchapter or the repeal or reduction of a tax under this
460	464		subchapter takes effect on the first day of the first calendar
461	465		quarter that occurs after the date the comptroller receives the
462	466		copy of the resolution as required by Section 323.405(b), Tax Code.
463	467		Sec. 3951.255. SALES AND USE TAX RATE. (a) On adoption of
464	468		the tax authorized by this subchapter, there is imposed a tax of two
465	469		percent, or the maximum rate at which the combined tax rate of all
466	470		local sales and use taxes in any location in the district does not
467	471		exceed two percent, on the receipts from the sale at retail of
468	472		taxable items in the district, and an excise tax on the use,
469	473		storage, or other consumption in the district of taxable items
470	474		purchased, leased, or rented from a retailer during the period that
471	475		the tax is in effect.
472	476		(b) The rate of the excise tax is the same as the rate of the
473	477		sales tax portion of the tax and is applied to the sales price of the
474	478		taxable item.
475	479		Sec. 3951.256. EXAMINATION AND RECEIPT OF INFORMATION. The
476	480		district may examine and receive information related to the
477	481		imposition of a sales and use tax to the same extent as if the
478	482		district were a municipality.
479	483		Sec. 3951.257. ALTERNATIVE METHOD OF IMPOSITION.
480	484		Notwithstanding any other provision of this subchapter, the
481	485		district may impose the sales and use tax as provided by Subchapter
482	486		F, Chapter 383, Local Government Code, instead of as provided by the
483	487		other provisions of this subchapter.
484	488		SUBCHAPTER G. DEFINED AREAS
485	489		Sec. 3951.301. AUTHORITY TO ESTABLISH DEFINED AREAS OR
486	490		DESIGNATED PROPERTY. The district may define areas or designate
487	491		certain property of the district to pay for improvements,
488	492		facilities, or services that primarily benefit that area or
489	493		property and do not generally and directly benefit the district as a
490	494		whole.
491	495		Sec. 3951.302. PROCEDURE FOR ELECTION. (a) Before the
492	496		district may impose an ad valorem tax or issue bonds payable from ad
493	497		valorem taxes of the defined area or designated property, the board
494	498		shall hold an election in the defined area or in the designated
495	499		property only.
496	500		(b) The board may submit the issues to the voters on the same
497	501		ballot to be used in another election.
498	502		Sec. 3951.303. DECLARING RESULT AND ISSUING ORDER. If a
499	503		majority of the voters voting at the election approve the
500	504		proposition or propositions, the board shall declare the results
501	505		and, by order, shall establish the defined area and describe it by
502	506		metes and bounds or designate the specific property.
503	507		Sec. 3951.304. TAXES FOR SERVICES, IMPROVEMENTS, AND
504	508		FACILITIES IN DEFINED AREAS OR DESIGNATED PROPERTY. On voter
505	509		approval and adoption of the order described by Section 3951.303,
506	510		the district may apply separately, differently, equitably, and
507	511		specifically its taxing power and lien authority to the defined
508	512		area or designated property to provide money to construct,
509	513		administer, maintain, and operate services, improvements, and
510	514		facilities that primarily benefit the defined area or designated
511	515		property.
512	516		Sec. 3951.305. ISSUANCE OF BONDS FOR DEFINED AREA OR
513	517		DESIGNATED PROPERTY. After the order under Section 3951.303 is
514	518		adopted, the district may issue bonds to provide for any land,
515	519		improvements, facilities, plants, equipment, and appliances for
516	520		the defined area or designated property.
517	521		SUBCHAPTER H. DISSOLUTION OF DISTRICT
518	522		Sec. 3951.351. DISSOLUTION. (a) Except as provided by
519	523		Subsection (b), the board:
520	524		(1) may dissolve the district; and
521	525		(2) shall dissolve the district on receipt of a
522	526		written petition requesting dissolution signed by the owners of 75
523	527		percent of the acreage of real property in the district.
524	528		(b) The board may not dissolve the district until the
525	529		district's outstanding indebtedness or contractual obligations
526	530		have been repaid or discharged.
527	531		(c) After the board dissolves the district, the board shall
528	532		transfer ownership of all district property and assets to the
529	533		county.
530	534		SECTION 2. The Lakewood Improvement District of Harris
531	535		County initially includes all the territory contained in the
532	536		following area:
