46 AN ACT
57 relating to the dissolution of the Angelina County Water Control
68 and Improvement District No. 3 and the territory of the Angelina
79 County Fresh Water Supply District No. 1.
810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. (a) Beginning on the effective date of this
1012 Act, the directors of the Angelina County Water Control and
1113 Improvement District No. 3 shall wind up the affairs of the
1214 district.
1315 (b) On the 30th day after the effective date of this Act:
1416 (1) the Angelina County Water Control and Improvement
1517 District No. 3 is dissolved;
1618 (2) the terms of the directors of the district expire;
1719 and
1820 (3) all assets and liabilities of the district are
1921 transferred to the Angelina County Fresh Water Supply District No.
2022 1.
2123 SECTION 2. Subtitle B, Title 6, Special District Local Laws
2224 Code, is amended by adding Chapter 6918 to read as follows:
2325 CHAPTER 6918. ANGELINA COUNTY FRESH WATER SUPPLY DISTRICT NO. 1;
2426 TERRITORY
2527 Sec. 6918.001. DEFINITION. In this chapter, "district"
2628 means the Angelina County Fresh Water Supply District No. 1.
2729 Sec. 6918.002. ADDITIONAL TERRITORY. On the effective date
2830 of the Act enacting this chapter, the territory of the former
2931 Angelina County Water Control and Improvement District No. 3, as
3032 that territory existed on April 1, 2017, is added to the territory
3133 of the district.
3234 SECTION 3. Before the 30th day after the effective date of
3335 this Act, the board of directors of the Angelina County Water
3436 Control and Improvement District No. 3 may select from the members
3537 serving on the board on the date of the selection one member to
3638 serve as a nonvoting member of the board of the Angelina County
3739 Fresh Water Supply District No. 1 from the date of the selection
3840 until the next election of directors for the Angelina County Fresh
3941 Water Supply District No. 1.
4042 SECTION 4. (a) The legal notice of the intention to
4143 introduce this Act, setting forth the general substance of this
4244 Act, has been published as provided by law, and the notice and a
4345 copy of this Act have been furnished to all persons, agencies,
4446 officials, or entities to which they are required to be furnished
4547 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
4648 Government Code.
4749 (b) The governor, one of the required recipients, has
4850 submitted the notice and Act to the Texas Commission on
4951 Environmental Quality.
5052 (c) The Texas Commission on Environmental Quality has filed
5153 its recommendations relating to this Act with the governor, the
5254 lieutenant governor, and the speaker of the house of
5355 representatives within the required time.
5456 (d) All requirements of the constitution and laws of this
5557 state and the rules and procedures of the legislature with respect
5658 to the notice, introduction, and passage of this Act are fulfilled
5759 and accomplished.
5860 SECTION 5. This Act takes effect immediately if it receives
5961 a vote of two-thirds of all the members elected to each house, as
6062 provided by Section 39, Article III, Texas Constitution. If this
6163 Act does not receive the vote necessary for immediate effect, this
6264 Act takes effect September 1, 2017.
