4	6		AN ACT
5	7		relating to the boundaries of the Harris County Fresh Water Supply
6	8		District No. 58.
7	9		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	10		SECTION 1. DEFINITION. In this Act, "district" means the
9	11		Harris County Fresh Water Supply District No. 58.
10	12		SECTION 2. EXCLUSION OF TERRITORY. The boundaries of the
11	13		district are adjusted to exclude the following parcel of land:
12	14		BEING ALL THAT CERTAIN TRACT OR PARCEL OF LAND CONTAINING
13	15		138.03 ACRES OF LAND SITUATED IN THE WILLIAM WHITLOCK SURVEY,
14	16		ABSTRACT NO. 85, HARRIS COUNTY, TEXAS, AND BEING ALL OF A CALLED
15	17		60.288 ACRE TRACT BEING PLATTED AS INDIAN SHORES SECTIONS NINE (9)
16	18		AND TEN (10), UNRECORDED AND A CALLED 77.817 ACRE TRACT RECORDED IN
17	19		VOLUME 1250, PAGE 74 HARRIS COUNTY DEED RECORDS, SAID 138.03 ACRE
18	20		TRACT BEING THE SAME 138.0268 ACRE TRACT AS RECORDED IN H.C.C.F., NO
19	21		W777169 AND BEING MORE PARTICULARLY DESCRIBED BY METES AND BOUNDS,
20	22		AS FOLLOWS TO-WIT:
21	23		Beginning at a 5/8 inch iron rod found in the north line of a
22	24		called 233.8 acre tract as recorded in H.C.C.F. No. Y604056 and
23	25		same being the Southeast corner of lot Four (4), Block Eighteen (18)
24	26		of Indian Shores Section 3, according to the map or plat recorded in
25	27		Volume 131, Page 32 Harris County Map Records (HCMR) and being the
26	28		Southeast corner of the called 60.288 acre tract and the Southeast
27	29		corner and PLACE OF BEGINNING of the tract herein described.
28	30		THENCE NORTH 87 DEGREES 42 MINUTES 19 SECONDS EAST, a
29	31		distance of 2299.67 feet with the north line of the Wheless tract to
30	32		a 1 inch iron pipe found for the Southwest corner Lot 1, Block 8 of
31	33		Rustic Acres Section 2, according to the map or plat recorded in
32	34		Volume 104, Page 809 Block Book for Harris County and being the
33	35		Southeast corner of the called 77.817 acre tract and the Southeast
34	36		corner of this tract herein described.
35	37		THENCE NORTH 17 DEGREES 11 MINUTES 18 SECONDS EAST, a
36	38		distance of 1499.32 feet, (called 1500.55 feet), with the west line
37	39		of said Rustic Acres Section 2 to a 5/8 inch iron rod found at the
38	40		intersection of the south right-of-way of Stoker Road, having a
39	41		right-of-way width of 100 feet, for the Northwest corner of Rustic
40	42		Acres Section 2 and same being the Southwest corner of Indian Shores
41	43		Section 6 according to the map of plat filed in Volume 165, Page 52
42	44		HCMR.
43	45		THENCE NORTH 17 DEGREES 05 MINUTES 22 SECONDS EAST, a
44	46		distance of 644.33 feet with the west line of said Indian Shores
45	47		Section 6 to a 5/8 inch iron rod found in the south line of Lot 2,
46	48		Block 6 of Indian Shores Section One according to the map or plat
47	49		recorded in Volume 119, Page 63 HCMR for the Northwest corner of
48	50		Indian Shores Section 6 and the Northeast corner of this tract
49	51		herein described.
50	52		THENCE FOLLOWING THE SOUTH BOUNDARY OF INDIAN SHORES SECTION

115	117		SECTION 3. RIGHTS OF BONDHOLDERS. The exclusion of
116	118		property under this Act does not diminish or impair the rights of
117	119		the holders of any outstanding and unpaid bonds, warrants, or other
118	120		certificates of indebtedness of the district.
119	121		SECTION 4. APPORTIONMENT OF DISTRICT INDEBTEDNESS.
120	122		(a) The excluded property is not released from the payment of its
121	123		pro rata share of the district's indebtedness.
122	124		(b) The district shall continue to levy taxes each year on
123	125		the property excluded from the district at the same rate levied on
124	126		other property of the district until the taxes collected from the
125	127		excluded property equal the property's pro rata share of the
126	128		indebtedness of the district on the effective date of this Act. The
127	129		taxes collected shall be applied exclusively to the payment of the
128	130		excluded property's pro rata share of the indebtedness.
129	131		(c) The owner of any part of the excluded property at any
130	132		time may pay in full the owner's share of the pro rata share of the
131	133		indebtedness of the district.
132	134		SECTION 5. NOTICE. (a) The legal notice of the intention
133	135		to introduce this Act, setting forth the general substance of this
134	136		Act, has been published as provided by law, and the notice and a
135	137		copy of this Act have been furnished to all persons, agencies,
136	138		officials, or entities to which they are required to be furnished
137	139		under Section 59, Article XVI, Texas Constitution, and Chapter 313,
138	140		Government Code.
139	141		(b) The governor, one of the required recipients, has
140	142		submitted the notice and Act to the Texas Commission on
141	143		Environmental Quality.
142	144		(c) The Texas Commission on Environmental Quality has filed
143	145		its recommendations relating to this Act with the governor, the
144	146		lieutenant governor, and the speaker of the house of
145	147		representatives within the required time.
146	148		(d) All requirements of the constitution and laws of this
147	149		state and the rules and procedures of the legislature with respect
148	150		to the notice, introduction, and passage of this Act are fulfilled
149	151		and accomplished.
150	152		SECTION 6. EFFECTIVE DATE. This Act takes effect
151	153		immediately if it receives a vote of two-thirds of all the members
152	154		elected to each house, as provided by Section 39, Article III, Texas
153	155		Constitution. If this Act does not receive the vote necessary for
154	156		immediate effect, this Act takes effect September 1, 2017.
