5- A BILL TO BE ENTITLED
64 AN ACT
75 relating to an adult high school diploma and industry certification
86 charter school pilot program.
97 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
108 SECTION 1. Section 29.259, Education Code, is amended by
119 amending Subsections (d) and (i) and adding Subsections (n), (o),
1210 (p), (q), and (r) to read as follows:
1311 (d) Notwithstanding any other law and in addition to the
1412 number of charters allowed under Subchapter D, Chapter 12, the
1513 commissioner [a charter under the pilot program] may, on the basis
1614 of an application submitted, grant a charter under the pilot
1715 program [be granted] to a single nonprofit entity described by
1816 Subsection (e) to provide an adult education program for [not more
1917 than 150] individuals described by Subsection (g) to successfully
2018 complete:
2119 (1) a high school program that can lead to a diploma;
2220 and
2321 (2) career and technology education courses that can
2422 lead to industry certification.
2523 (i) A charter granted under this section must:
2624 (1) include a description of the adult education
2725 program to be offered under this section; and
2826 (2) establish specific, objective standards for
2927 receiving a high school diploma, including:
3028 (A) successful completion of:
3129 (i) if applicable to the program
3230 participant, the curriculum requirements under Section 28.025; or
3331 (ii) the appropriate curriculum
3432 requirements applicable to the program participant; and
3533 (B) satisfactory performance on the standardized
3634 secondary exit-level assessment instrument described by Subsection
3735 (c).
3836 (n) An adult education program operated under a charter
3937 granted under this section is subject to:
4038 (1) a provision of this title establishing a criminal
4139 offense; and
4240 (2) a prohibition, restriction, or requirement, as
4341 applicable, imposed by this title or a rule adopted under this
4442 title, relating to:
4543 (A) the Public Education Information Management
4644 System (PEIMS) to the extent necessary as determined by the
4745 commissioner to monitor compliance with this section and, as
4846 applicable, Subchapter D, Chapter 12;
4947 (B) criminal history records under Subchapter C,
5048 Chapter 22;
5149 (C) high school graduation requirements under
5250 Section 28.025, to the extent applicable to a program participant;
5351 (D) special education programs under Subchapter
5452 A, Chapter 29;
5553 (E) bilingual education under Subchapter B,
5654 Chapter 29;
5755 (F) health and safety under Chapter 38;
5856 (G) the requirement under Section 21.006 to
5957 report an educator's misconduct; and
6058 (H) the right of an employee to report a crime, as
6159 provided by Section 37.148.
6260 (o) The commissioner shall develop and adopt performance
6361 frameworks that establish standards by which to measure the
6462 performance of an adult high school program operated under a
6563 charter granted under this section in a manner consistent with the
6664 requirements provided for an open-enrollment charter school under
6765 Sections 12.1181(a) and (b). The commissioner shall include in the
6866 performance frameworks adopted under this subsection the following
6967 performance indicators:
7068 (1) the percentage of program participants who
7169 performed satisfactorily on the standardized secondary exit-level
7270 assessment instrument described by Subsection (c);
7371 (2) the percentage of program participants who
7472 successfully completed the high school program and earned a high
7573 school diploma;
7674 (3) the percentage of program participants who
7775 successfully completed career and technology education courses and
7876 obtained industry certification;
7977 (4) the percentage of program participants who have
8078 enrolled in an institution of higher education or private or
8179 independent institution of higher education, as those terms are
8280 defined under Section 61.003; and
8381 (5) the percentage of program participants who earned
8482 a wage, salary, or other income increase that was significant as
8583 determined and reported by the Texas Workforce Commission.
8684 (p) Each year, the commissioner shall evaluate the
8785 performance of an adult high school program operated under a
8886 charter granted under this section based on the applicable
8987 performance frameworks adopted under Subsection (o).
9088 (q) The commissioner shall adopt rules as necessary to
9189 implement and administer the reporting requirements under
9290 Subsection (n)(2)(A) and the evaluation provisions of Subsections
9391 (o) and (p).
9492 (r) The commissioner or an adult education program operated
9593 under a charter granted under this section may accept gifts,
9694 grants, or donations from any public or private source to be used
9795 for purposes of this section.
9896 SECTION 2. Section 29.259(l), Education Code, is repealed.
9997 SECTION 3. Section 29.259(p), Education Code, as added by
10098 this Act, applies beginning with the 2017-2018 school year.
10199 SECTION 4. Section 29.259(d), Education Code, as amended by
102100 this Act, takes effect only if a specific appropriation is provided
103101 for additional funding for the increase in the number of program
104102 participants above 150 in a general appropriations act of the 85th
105103 Legislature.
106104 SECTION 5. This Act takes effect immediately if it receives
107105 a vote of two-thirds of all the members elected to each house, as
108106 provided by Section 39, Article III, Texas Constitution. If this
109107 Act does not receive the vote necessary for immediate effect, this
110108 Act takes effect September 1, 2017.
