The bill would amend the Government Code requiring the Office of Inspector General (IG) to show an ongoing significant financial risk to the state may as part of the basis for a payment hold and, in consultation with the executive commission of the Health and Human Services Commission (HHSC), adopt rules regarding what constitutes a threat to the integrity of Medicaid for purposes of refining certain definitions related to Medicaid fraud.The bill would take effect immediately upon a two-thirds vote from all member s of each house or, in such a vote is not received, on September 1, 2017.Based on the Legislative Budget Board analysis of HHSC and the IG, duties and responsibilities associated with showing an financial risk as part of a payment hold and adopting rules could be accomplished by utilizing existing resources.
