66 AN ACT
77 relating to a prohibition against the use of stun guns and Tasers
88 against public school students.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 37, Education Code, is
1111 amended by adding Section 37.0815 to read as follows:
1212 Sec. 37.0815. USE OF STUN GUN OR TASER AGAINST STUDENTS
1313 PROHIBITED. (a) In this section:
1414 (1) "Stun gun" has the meaning assigned by Section
1515 38.14, Penal Code.
1616 (2) "Taser" means a device manufactured, sold, or
1717 distributed by Taser International, Incorporated, that is
1818 intended, designed, made, or adapted to incapacitate a person by
1919 inflicting an electrical charge through the emission of a
2020 projectile or conductive stream. The term, for purposes of this
2121 section, includes a similar device manufactured, sold, or
2222 distributed by another person.
2323 (b) Except as provided by Subsection (c), the use by school
2424 district peace officers, security personnel, and other employees
2525 and peace officers of a stun gun or Taser to subdue a student on
2626 school property or while attending a school-sponsored or
2727 school-related activity off of school property is prohibited.
2828 (c) Subsection (b) does not prohibit a person from using a
2929 stun gun or Taser to subdue a student who possesses a weapon if the
3030 person sees the weapon and believes the student poses an imminent
3131 risk of causing bodily injury to another student, a peace officer, a
3232 school employee, or another person. A presumption that a student
3333 possesses a weapon is not sufficient for purposes of this
3434 subsection.
3535 SECTION 2. This Act takes effect immediately if it receives
3636 a vote of two-thirds of all the members elected to each house, as
3737 provided by Section 39, Article III, Texas Constitution. If this
3838 Act does not receive the vote necessary for immediate effect, this
3939 Act takes effect September 1, 2017.
