105 AN ACT
116 relating to the regulation of automotive wrecking and salvage yards
127 in certain counties.
138 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
149 SECTION 1. Section 397.0125(a), Transportation Code, is
1510 amended to read as follows:
1611 (a) In addition to the penalty provided by Section 397.012,
1712 a person who operates an automotive wrecking and salvage yard in
1813 violation of this chapter is liable for a civil penalty of not less
1914 than $500 or more than $5,000 [$1,000] for each violation. A
2015 separate penalty may be imposed for each day a continuing violation
2116 occurs.
2217 SECTION 2. The change in law made by this Act applies only
2318 to a violation of Chapter 397, Transportation Code, that occurs on
2419 or after the effective date of this Act. A violation of that
2520 chapter that occurred before the effective date of this Act is
2621 governed by the law in effect when the violation occurred, and the
2722 former law is continued in effect for that purpose.
2823 SECTION 3. This Act takes effect September 1, 2017.
