13 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

14 | 9 | | SECTION 1. Section 397.0125(a), Transportation Code, is |
---|
15 | 10 | | amended to read as follows: |
---|
16 | 11 | | (a) In addition to the penalty provided by Section 397.012, |
---|
17 | 12 | | a person who operates an automotive wrecking and salvage yard in |
---|
18 | 13 | | violation of this chapter is liable for a civil penalty of not less |
---|
19 | 14 | | than $500 or more than $5,000 [$1,000] for each violation. A |
---|
20 | 15 | | separate penalty may be imposed for each day a continuing violation |
---|
21 | 16 | | occurs. |
---|
22 | 17 | | SECTION 2. The change in law made by this Act applies only |
---|
23 | 18 | | to a violation of Chapter 397, Transportation Code, that occurs on |
---|
24 | 19 | | or after the effective date of this Act. A violation of that |
---|
25 | 20 | | chapter that occurred before the effective date of this Act is |
---|
26 | 21 | | governed by the law in effect when the violation occurred, and the |
---|
27 | 22 | | former law is continued in effect for that purpose. |
---|
28 | 23 | | SECTION 3. This Act takes effect September 1, 2017. |
