105 AN ACT
116 relating to the prosecution of the offense of operation of unmanned
127 aircraft over correctional facility or critical infrastructure
138 facility.
149 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1510 SECTION 1. The heading to Section 423.0045, Government
1611 Code, is amended to read as follows:
1712 Sec. 423.0045. OFFENSE: OPERATION OF UNMANNED AIRCRAFT
1813 OVER CORRECTIONAL FACILITY OR CRITICAL INFRASTRUCTURE FACILITY.
1914 SECTION 2. Section 423.0045(a), Government Code, is amended
2015 by amending Subdivision (1) and adding Subdivision (1-a) to read as
2116 follows:
2217 (1) "Correctional facility" means:
2318 (A) a confinement facility operated by or under
2419 contract with any division of the Texas Department of Criminal
2520 Justice;
2621 (B) a municipal or county jail; or
2722 (C) a secure correctional facility or secure
2823 detention facility, as defined by Section 51.02, Family Code.
2924 (1-a) "Critical infrastructure facility" means:
3025 (A) one of the following, if completely enclosed
3126 by a fence or other physical barrier that is obviously designed to
3227 exclude intruders, or if clearly marked with a sign or signs that
3328 are posted on the property, are reasonably likely to come to the
3429 attention of intruders, and indicate that entry is forbidden:
3530 (i) a petroleum or alumina refinery;
3631 (ii) an electrical power generating
3732 facility, substation, switching station, or electrical control
3833 center;
3934 (iii) a chemical, polymer, or rubber
4035 manufacturing facility;
4136 (iv) a water intake structure, water
4237 treatment facility, wastewater treatment plant, or pump station;
4338 (v) a natural gas compressor station;
4439 (vi) a liquid natural gas terminal or
4540 storage facility;
4641 (vii) a telecommunications central
4742 switching office;
4843 (viii) a port, railroad switching yard,
4944 trucking terminal, or other freight transportation facility;
5045 (ix) a gas processing plant, including a
5146 plant used in the processing, treatment, or fractionation of
5247 natural gas;
5348 (x) a transmission facility used by a
5449 federally licensed radio or television station;
5550 (xi) a steelmaking facility that uses an
5651 electric arc furnace to make steel; or
5752 (xii) a dam that is classified as a high
5853 hazard by the Texas Commission on Environmental Quality; or
5954 (B) any portion of an aboveground oil, gas, or
6055 chemical pipeline that is enclosed by a fence or other physical
6156 barrier that is obviously designed to exclude intruders.
6257 SECTION 3. Sections 423.0045(b) and (c), Government Code,
6358 are amended to read as follows:
6459 (b) A person commits an offense if the person intentionally
6560 or knowingly:
6661 (1) operates an unmanned aircraft over a correctional
6762 facility or critical infrastructure facility and the unmanned
6863 aircraft is not higher than 400 feet above ground level;
6964 (2) allows an unmanned aircraft to make contact with a
7065 correctional facility or critical infrastructure facility,
7166 including any person or object on the premises of or within the
7267 facility; or
7368 (3) allows an unmanned aircraft to come within a
7469 distance of a correctional facility or critical infrastructure
7570 facility that is close enough to interfere with the operations of or
7671 cause a disturbance to the facility.
7772 (c) This section does not apply to:
7873 (1) conduct described by Subsection (b) that involves
7974 a correctional facility or critical infrastructure facility and
8075 [that] is committed by:
8176 (A) [(1)] the federal government, the state, or a
8277 governmental entity;
8378 (B) [(2)] a person under contract with or
8479 otherwise acting under the direction or on behalf of the federal
8580 government, the state, or a governmental entity;
8681 (C) [(3)] a law enforcement agency;
8782 (D) [(4)] a person under contract with or
8883 otherwise acting under the direction or on behalf of a law
8984 enforcement agency; or
9085 (E) an operator of an unmanned aircraft that is
9186 being used for a commercial purpose, if the operator is authorized
9287 by the Federal Aviation Administration to conduct operations over
9388 that airspace; or
9489 (2) conduct described by Subsection (b) that involves
9590 a critical infrastructure facility and is committed by:
9691 (A) [(5)] an owner or operator of the critical
9792 infrastructure facility;
9893 (B) [(6)] a person under contract with or
9994 otherwise acting under the direction or on behalf of an owner or
10095 operator of the critical infrastructure facility;
10196 (C) [(7)] a person who has the prior written
10297 consent of the owner or operator of the critical infrastructure
10398 facility; or
10499 (D) [(8)] the owner or occupant of the property
105100 on which the critical infrastructure facility is located or a
106101 person who has the prior written consent of the owner or occupant of
107102 that property[; or
108103 [(9) an operator of an unmanned aircraft that is being
109104 used for a commercial purpose, if the operator is authorized by the
110105 Federal Aviation Administration to conduct operations over that
111106 airspace].
112107 SECTION 4. The change in law made by this Act applies only
113108 to an offense committed on or after the effective date of this Act.
114109 An offense committed before the effective date of this Act is
115110 governed by the law in effect on the date the offense was committed,
116111 and the former law is continued in effect for that purpose. For
117112 purposes of this section, an offense was committed before the
118113 effective date of this Act if any element of the offense occurred
119114 before that date.
120115 SECTION 5. This Act takes effect September 1, 2017.
