| 9 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 8 | | SECTION 1. Section 28.004(c), Education Code, is amended to |
|---|
| 11 | 9 | | read as follows: |
|---|
| 12 | 10 | | (c) The local school health advisory council's duties |
|---|
| 13 | 11 | | include recommending: |
|---|
| 14 | 12 | | (1) the number of hours of instruction to be provided |
|---|
| 15 | 13 | | in health education; |
|---|
| 16 | 14 | | (2) policies, procedures, strategies, and curriculum |
|---|
| 17 | 15 | | appropriate for specific grade levels designed to prevent obesity, |
|---|
| 18 | 16 | | cardiovascular disease, Type 2 diabetes, and mental health concerns |
|---|
| 19 | 17 | | through coordination of: |
|---|
| 20 | 18 | | (A) health education; |
|---|
| 21 | 19 | | (B) physical education and physical activity; |
|---|
| 22 | 20 | | (C) nutrition services; |
|---|
| 23 | 21 | | (D) parental involvement; |
|---|
| 24 | 22 | | (E) instruction to prevent the use of |
|---|
| 25 | 23 | | e-cigarettes, as defined by Section 161.081, Health and Safety |
|---|
| 26 | 24 | | Code, and tobacco; |
|---|
| 27 | 25 | | (F) school health services; |
|---|
| 28 | 26 | | (G) counseling and guidance services; |
|---|
| 29 | 27 | | (H) a safe and healthy school environment; and |
|---|
| 30 | 28 | | (I) school employee wellness; |
|---|
| 31 | 29 | | (3) appropriate grade levels and methods of |
|---|
| 32 | 30 | | instruction for human sexuality instruction; |
|---|
| 33 | 31 | | (4) strategies for integrating the curriculum |
|---|
| 34 | 32 | | components specified by Subdivision (2) with the following elements |
|---|
| 35 | 33 | | in a coordinated school health program for the district: |
|---|
| 36 | 34 | | (A) school health services; |
|---|
| 37 | 35 | | (B) counseling and guidance services; |
|---|
| 38 | 36 | | (C) a safe and healthy school environment; and |
|---|
| 39 | 37 | | (D) school employee wellness; and |
|---|
| 40 | 38 | | (5) if feasible, joint use agreements or strategies |
|---|
| 41 | 39 | | for collaboration between the school district and community |
|---|
| 42 | 40 | | organizations or agencies. |
|---|
| 43 | 41 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 44 | 42 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 45 | 43 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 46 | 44 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 47 | 45 | | Act takes effect September 1, 2017. |
