5- A BILL TO BE ENTITLED
64 AN ACT
75 relating to recommendations regarding instruction in public
86 schools to prevent the use of e-cigarettes.
97 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
108 SECTION 1. Section 28.004(c), Education Code, is amended to
119 read as follows:
1210 (c) The local school health advisory council's duties
1311 include recommending:
1412 (1) the number of hours of instruction to be provided
1513 in health education;
1614 (2) policies, procedures, strategies, and curriculum
1715 appropriate for specific grade levels designed to prevent obesity,
1816 cardiovascular disease, Type 2 diabetes, and mental health concerns
1917 through coordination of:
2018 (A) health education;
2119 (B) physical education and physical activity;
2220 (C) nutrition services;
2321 (D) parental involvement;
2422 (E) instruction to prevent the use of
2523 e-cigarettes, as defined by Section 161.081, Health and Safety
2624 Code, and tobacco;
2725 (F) school health services;
2826 (G) counseling and guidance services;
2927 (H) a safe and healthy school environment; and
3028 (I) school employee wellness;
3129 (3) appropriate grade levels and methods of
3230 instruction for human sexuality instruction;
3331 (4) strategies for integrating the curriculum
3432 components specified by Subdivision (2) with the following elements
3533 in a coordinated school health program for the district:
3634 (A) school health services;
3735 (B) counseling and guidance services;
3836 (C) a safe and healthy school environment; and
3937 (D) school employee wellness; and
4038 (5) if feasible, joint use agreements or strategies
4139 for collaboration between the school district and community
4240 organizations or agencies.
4341 SECTION 2. This Act takes effect immediately if it receives
4442 a vote of two-thirds of all the members elected to each house, as
4543 provided by Section 39, Article III, Texas Constitution. If this
4644 Act does not receive the vote necessary for immediate effect, this
4745 Act takes effect September 1, 2017.
