| 16 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 17 | 10 | | SECTION 1. Section 58.006, Education Code, is amended by |
|---|
| 18 | 11 | | amending Subsection (b) and adding Subsection (d) to read as |
|---|
| 19 | 12 | | follows: |
|---|
| 20 | 13 | | (b) An organization eligible to receive funds under this |
|---|
| 21 | 14 | | subsection must: |
|---|
| 22 | 15 | | (1) qualify for exemption from federal income tax |
|---|
| 23 | 16 | | under Section 501, Internal Revenue Code of 1986 (26 U.S.C. Section |
|---|
| 24 | 17 | | 501); or |
|---|
| 25 | 18 | | (2) be operated by a state accredited medical school |
|---|
| 26 | 19 | | [as defined in Section 61.501(1)]. |
|---|
| 27 | 20 | | (d) For purposes of this section, "medical school" has the |
|---|
| 28 | 21 | | meaning assigned by Section 61.501(1), except that the term also |
|---|
| 29 | 22 | | includes the school of osteopathic medicine at the University of |
|---|
| 30 | 23 | | the Incarnate Word. |
|---|
| 31 | 24 | | SECTION 2. Subchapter C, Chapter 58A, Education Code, is |
|---|
| 32 | 25 | | amended by adding Section 58A.0505 to read as follows: |
|---|
| 33 | 26 | | Sec. 58A.0505. DEFINITION OF MEDICAL SCHOOL. For purposes |
|---|
| 34 | 27 | | of this subchapter, "medical school" also includes the school of |
|---|
| 35 | 28 | | osteopathic medicine at the University of the Incarnate Word. |
|---|
| 36 | 29 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 37 | 30 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 38 | 31 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 39 | 32 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 40 | 33 | | Act takes effect September 1, 2017. |
