1111 A BILL TO BE ENTITLED
1212 AN ACT
1313 relating to the posting by the Railroad Commission of Texas on its
1414 Internet website of certain enforcement information.
1515 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1616 SECTION 1. Subchapter C, Chapter 81, Natural Resources
1717 Code, is amended by adding Section 81.071 to read as follows:
1818 Sec. 81.071. ENFORCEMENT INFORMATION. (a) The commission
1919 shall post on the commission's Internet website:
2020 (1) comprehensive information regarding the
2121 commission's enforcement of this title and rules, orders, licenses,
2222 permits, and certificates issued under this title, including
2323 information regarding:
2424 (A) inspection and enforcement activity;
2525 (B) violations; and
2626 (C) the amount of penalties finally assessed;
2727 (2) information evidencing quarterly trends regarding
2828 enforcement activity by the commission, including:
2929 (A) the number of inspections conducted;
3030 (B) the number of violations, categorized
3131 according to the degree of severity of the violation and the
3232 statute, rule, order, license, permit, or certificate violated, for
3333 which enforcement action has been taken;
3434 (C) the number of repeat violations determined to
3535 have been committed; and
3636 (D) the number of violations referred to the
3737 attorney general for enforcement; and
3838 (3) an analysis of annual trends regarding enforcement
3939 activity by the commission.
4040 (b) Information required to be posted under this section
4141 must be:
4242 (1) in a searchable format;
4343 (2) organized by county, by operator or other entity,
4444 and by well, if applicable; and
4545 (3) capable of being downloaded in bulk.
4646 SECTION 2. The Railroad Commission of Texas shall comply
4747 with Section 81.071(b), Natural Resources Code, as added by this
4848 Act, not later than January 1, 2019.
4949 SECTION 3. The Railroad Commission of Texas shall implement
5050 Section 81.071, Natural Resources Code, as added by this Act, using
5151 only money that is appropriated to the commission by the General
5252 Appropriations Act for the state fiscal biennium beginning
5353 September 1, 2017, for public information and services and that is
5454 available to be spent for the publication on the commission's
5555 Internet website of information about the commission's inspection
5656 and enforcement activities. If the commission determines that it
5757 is not required to implement that statute because the legislature
5858 has not appropriated money available for that purpose, the
5959 commission shall notify the Legislative Budget Board of that
6060 determination.
6161 SECTION 4. This Act takes effect September 1, 2017.
