55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a landowner's liability for injuries incurred during
88 certain recreational activities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 75.001(3), Civil Practice and Remedies
1111 Code, is amended to read as follows:
1212 (3) "Recreation" means an activity such as:
1313 (A) hunting;
1414 (B) fishing;
1515 (C) swimming;
1616 (D) boating;
1717 (E) camping;
1818 (F) picnicking;
1919 (G) hiking;
2020 (H) pleasure driving, including off-road
2121 motorcycling and off-road automobile driving and the use of
2222 all-terrain vehicles and recreational off-highway vehicles;
2323 (I) nature study, including bird-watching;
2424 (J) cave exploration;
2525 (K) waterskiing and other water sports;
2626 (L) any other activity associated with enjoying
2727 nature or the outdoors;
2828 (M) bicycling and mountain biking;
2929 (N) disc golf;
3030 (O) on-leash and off-leash walking of dogs; [or]
3131 (P) radio control flying and related activities;
3232 or
3333 (Q) rock climbing.
3434 SECTION 2. The change in law made by this Act applies only
3535 to a cause of action that accrues on or after the effective date of
3636 this Act. A cause of action that accrued before the effective date
3737 of this Act is governed by the law applicable to the cause of action
3838 immediately before the effective date of this Act, and that law is
3939 continued in effect for that purpose.
4040 SECTION 3. This Act takes effect immediately if it receives
4141 a vote of two-thirds of all the members elected to each house, as
4242 provided by Section 39, Article III, Texas Constitution. If this
4343 Act does not receive the vote necessary for immediate effect, this
4444 Act takes effect September 1, 2017.
