| 7 | 7 | | relating to a landowner's liability for injuries incurred during |

| 8 | 8 | | certain recreational activities. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 75.001(3), Civil Practice and Remedies |
|---|
| 11 | 11 | | Code, is amended to read as follows: |
|---|
| 12 | 12 | | (3) "Recreation" means an activity such as: |
|---|
| 13 | 13 | | (A) hunting; |
|---|
| 14 | 14 | | (B) fishing; |
|---|
| 15 | 15 | | (C) swimming; |
|---|
| 16 | 16 | | (D) boating; |
|---|
| 17 | 17 | | (E) camping; |
|---|
| 18 | 18 | | (F) picnicking; |
|---|
| 19 | 19 | | (G) hiking; |
|---|
| 20 | 20 | | (H) pleasure driving, including off-road |
|---|
| 21 | 21 | | motorcycling and off-road automobile driving and the use of |
|---|
| 22 | 22 | | all-terrain vehicles and recreational off-highway vehicles; |
|---|
| 23 | 23 | | (I) nature study, including bird-watching; |
|---|
| 24 | 24 | | (J) cave exploration; |
|---|
| 25 | 25 | | (K) waterskiing and other water sports; |
|---|
| 26 | 26 | | (L) any other activity associated with enjoying |
|---|
| 27 | 27 | | nature or the outdoors; |
|---|
| 28 | 28 | | (M) bicycling and mountain biking; |
|---|
| 29 | 29 | | (N) disc golf; |
|---|
| 30 | 30 | | (O) on-leash and off-leash walking of dogs; [or] |
|---|
| 31 | 31 | | (P) radio control flying and related activities; |
|---|
| 32 | 32 | | or |
|---|
| 33 | 33 | | (Q) rock climbing. |
|---|
| 34 | 34 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 35 | 35 | | to a cause of action that accrues on or after the effective date of |
|---|
| 36 | 36 | | this Act. A cause of action that accrued before the effective date |
|---|
| 37 | 37 | | of this Act is governed by the law applicable to the cause of action |
|---|
| 38 | 38 | | immediately before the effective date of this Act, and that law is |
|---|
| 39 | 39 | | continued in effect for that purpose. |
|---|
| 40 | 40 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 41 | 41 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 42 | 42 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 43 | 43 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 44 | 44 | | Act takes effect September 1, 2017. |
