99 relating to a sign required to be posted in the restrooms of
1010 sexually oriented businesses; creating a criminal offense.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 102, Business & Commerce Code, is
1313 amended by adding Subchapter C to read as follows:
1414 SUBCHAPTER C. NOTICE REQUIREMENTS ON PREMISES OF SEXUALLY ORIENTED
1515 BUSINESSES
1616 Sec. 102.101. POSTING OF CERTAIN SIGN REQUIRED. (a) A
1717 sexually oriented business shall post by the sink area in each
1818 restroom on the premises one sign that directs a victim of human
1919 trafficking to contact the National Human Trafficking Resource
2020 Center. Except as provided by Subsection (c), the sign must be 11
2121 inches by 17 inches in size.
2222 (b) The attorney general by rule shall prescribe the design,
2323 content, and manner of display of the sign required by this section.
2424 The sign must:
2525 (1) be in both English and Spanish; and
2626 (2) include the telephone number and Internet website
2727 of the National Human Trafficking Resource Center.
2828 (c) The attorney general by rule may require the sign to:
2929 (1) be in an additional language other than English or
3030 Spanish;
3131 (2) be larger than 11 inches by 17 inches in size if
3232 the attorney general determines that a larger sign is appropriate;
3333 and
3434 (3) include other information the attorney general
3535 considers necessary and appropriate.
3636 Sec. 102.102. CRIMINAL PENALTY. (a) A person commits an
3737 offense if the person:
3838 (1) is an owner or operator of a sexually oriented
3939 business; and
4040 (2) fails to post the sign required by Section 102.101
4141 in compliance with that section and rules adopted under that
4242 section.
4343 (b) An offense under this section is a Class C misdemeanor.
4444 SECTION 2. (a) The attorney general shall adopt rules to
4545 implement Section 102.101, Business & Commerce Code, as added by
4646 this Act, not later than September 1, 2018.
4747 (b) Each sexually oriented business shall post the sign
4848 required by Section 102.101, Business & Commerce Code, as added by
4949 this Act, not later than March 1, 2019.
5050 SECTION 3. (a) Except as provided by Subsection (b) of
5151 this section, this Act takes effect September 1, 2017.
5252 (b) Section 102.102, Business & Commerce Code, as added by
5353 this Act, takes effect March 1, 2019.
