11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Chapter 102, Business & Commerce Code, is |
---|
13 | 13 | | amended by adding Subchapter C to read as follows: |
---|
14 | 14 | | SUBCHAPTER C. NOTICE REQUIREMENTS ON PREMISES OF SEXUALLY ORIENTED |

15 | 15 | | BUSINESSES |
---|
16 | 16 | | Sec. 102.101. POSTING OF CERTAIN SIGN REQUIRED. (a) A |
---|
17 | 17 | | sexually oriented business shall post by the sink area in each |
---|
18 | 18 | | restroom on the premises one sign that directs a victim of human |
---|
19 | 19 | | trafficking to contact the National Human Trafficking Resource |
---|
20 | 20 | | Center. Except as provided by Subsection (c), the sign must be 11 |
---|
21 | 21 | | inches by 17 inches in size. |
---|
22 | 22 | | (b) The attorney general by rule shall prescribe the design, |
---|
23 | 23 | | content, and manner of display of the sign required by this section. |
---|
24 | 24 | | The sign must: |
---|
25 | 25 | | (1) be in both English and Spanish; and |
---|
26 | 26 | | (2) include the telephone number and Internet website |
---|
27 | 27 | | of the National Human Trafficking Resource Center. |
---|
28 | 28 | | (c) The attorney general by rule may require the sign to: |
---|
29 | 29 | | (1) be in an additional language other than English or |
---|
30 | 30 | | Spanish; |
---|
31 | 31 | | (2) be larger than 11 inches by 17 inches in size if |
---|
32 | 32 | | the attorney general determines that a larger sign is appropriate; |
---|
33 | 33 | | and |
---|
34 | 34 | | (3) include other information the attorney general |
---|
35 | 35 | | considers necessary and appropriate. |
---|
36 | 36 | | Sec. 102.102. CRIMINAL PENALTY. (a) A person commits an |
---|
37 | 37 | | offense if the person: |
---|
38 | 38 | | (1) is an owner or operator of a sexually oriented |
---|
39 | 39 | | business; and |
---|
40 | 40 | | (2) fails to post the sign required by Section 102.101 |
---|
41 | 41 | | in compliance with that section and rules adopted under that |
---|
42 | 42 | | section. |
---|
43 | 43 | | (b) An offense under this section is a Class C misdemeanor. |
---|
44 | 44 | | SECTION 2. (a) The attorney general shall adopt rules to |
---|
45 | 45 | | implement Section 102.101, Business & Commerce Code, as added by |
---|
46 | 46 | | this Act, not later than September 1, 2018. |
---|
47 | 47 | | (b) Each sexually oriented business shall post the sign |
---|
48 | 48 | | required by Section 102.101, Business & Commerce Code, as added by |
---|
49 | 49 | | this Act, not later than March 1, 2019. |
---|
50 | 50 | | SECTION 3. (a) Except as provided by Subsection (b) of |
---|
51 | 51 | | this section, this Act takes effect September 1, 2017. |
---|
52 | 52 | | (b) Section 102.102, Business & Commerce Code, as added by |
---|
53 | 53 | | this Act, takes effect March 1, 2019. |
