| 13 | 13 | | relating to the creation of the National Museum of the Pacific War |

| 15 | 15 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 16 | 16 | | SECTION 1. Section 442.053(c), Government Code, is amended |
|---|
| 17 | 17 | | to read as follows: |
|---|
| 18 | 18 | | (c) The commission shall deposit the proceeds of revenue |
|---|
| 19 | 19 | | bonds or other revenue obligations issued under this section in |
|---|
| 20 | 20 | | accordance with Chapter 1232 [to the credit of the National Museum |
|---|
| 21 | 21 | | of the Pacific War account] and may use the proceeds only to finance |
|---|
| 22 | 22 | | the repair, renovation, improvement, expansion, and equipping of |
|---|
| 23 | 23 | | the museum. |

| 24 | 24 | | SECTION 2. Subchapter B, Chapter 442, Government Code, is |
|---|
| 25 | 25 | | amended by adding Section 442.056 to read as follows: |
|---|
| 26 | 26 | | Sec. 442.056. NATIONAL MUSEUM OF THE PACIFIC WAR MUSEUM |
|---|
| 27 | 27 | | FUND. (a) In this section: |
|---|
| 28 | 28 | | (1) "Commission" means the Texas Historical |
|---|
| 29 | 29 | | Commission. |
|---|
| 30 | 30 | | (2) "Fund" means the National Museum of the Pacific |
|---|
| 31 | 31 | | War museum fund. |
|---|
| 32 | 32 | | (b) The National Museum of the Pacific War museum fund is |
|---|
| 33 | 33 | | created as a fund outside the state treasury. The commission shall |
|---|
| 34 | 34 | | administer the fund but may contract with the Admiral Nimitz |
|---|
| 35 | 35 | | Foundation for administration of the fund. The fund consists of: |
|---|
| 36 | 36 | | (1) admissions revenue from operation of the museum; |
|---|
| 37 | 37 | | and |
|---|
| 38 | 38 | | (2) donations made to the commission for the museum. |
|---|
| 39 | 39 | | (c) Money in the fund may be spent without appropriation and |
|---|
| 40 | 40 | | only to administer, operate, preserve, repair, expand, or otherwise |
|---|
| 41 | 41 | | maintain the museum. |
|---|
| 42 | 42 | | (d) Interest and income from the assets of the fund shall be |
|---|
| 43 | 43 | | credited to and deposited in the fund. |
|---|
| 44 | 44 | | SECTION 3. Section 442.054, Government Code, is repealed. |
|---|
| 45 | 45 | | SECTION 4. The Texas Historical Commission is required to |
|---|
| 46 | 46 | | implement Section 442.056, Government Code, as added by this Act, |
|---|
| 47 | 47 | | only if the legislature appropriates money specifically for that |
|---|
| 48 | 48 | | purpose. If the legislature does not appropriate money |
|---|
| 49 | 49 | | specifically for that purpose, the commission may, but is not |
|---|
| 50 | 50 | | required to, implement that section using other appropriations |
|---|
| 51 | 51 | | available to the commission for that purpose. |
|---|
| 52 | 52 | | SECTION 5. This Act takes effect immediately if it receives |
|---|
| 53 | 53 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 54 | 54 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 55 | 55 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 56 | 56 | | Act takes effect September 1, 2017. |
