1111 A BILL TO BE ENTITLED
1212 AN ACT
1313 relating to the creation of the National Museum of the Pacific War
1414 museum fund.
1515 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1616 SECTION 1. Section 442.053(c), Government Code, is amended
1717 to read as follows:
1818 (c) The commission shall deposit the proceeds of revenue
1919 bonds or other revenue obligations issued under this section in
2020 accordance with Chapter 1232 [to the credit of the National Museum
2121 of the Pacific War account] and may use the proceeds only to finance
2222 the repair, renovation, improvement, expansion, and equipping of
2323 the museum.
2424 SECTION 2. Subchapter B, Chapter 442, Government Code, is
2525 amended by adding Section 442.056 to read as follows:
2626 Sec. 442.056. NATIONAL MUSEUM OF THE PACIFIC WAR MUSEUM
2727 FUND. (a) In this section:
2828 (1) "Commission" means the Texas Historical
2929 Commission.
3030 (2) "Fund" means the National Museum of the Pacific
3131 War museum fund.
3232 (b) The National Museum of the Pacific War museum fund is
3333 created as a fund outside the state treasury. The commission shall
3434 administer the fund but may contract with the Admiral Nimitz
3535 Foundation for administration of the fund. The fund consists of:
3636 (1) admissions revenue from operation of the museum;
3737 and
3838 (2) donations made to the commission for the museum.
3939 (c) Money in the fund may be spent without appropriation and
4040 only to administer, operate, preserve, repair, expand, or otherwise
4141 maintain the museum.
4242 (d) Interest and income from the assets of the fund shall be
4343 credited to and deposited in the fund.
4444 SECTION 3. Section 442.054, Government Code, is repealed.
4545 SECTION 4. The Texas Historical Commission is required to
4646 implement Section 442.056, Government Code, as added by this Act,
4747 only if the legislature appropriates money specifically for that
4848 purpose. If the legislature does not appropriate money
4949 specifically for that purpose, the commission may, but is not
5050 required to, implement that section using other appropriations
5151 available to the commission for that purpose.
5252 SECTION 5. This Act takes effect immediately if it receives
5353 a vote of two-thirds of all the members elected to each house, as
5454 provided by Section 39, Article III, Texas Constitution. If this
5555 Act does not receive the vote necessary for immediate effect, this
5656 Act takes effect September 1, 2017.
