75 relating to transition planning for a public school student
86 enrolled in a special education program.
97 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
108 SECTION 1. Section 29.011, Education Code, is amended to
119 read as follows:
1210 Sec. 29.011. TRANSITION PLANNING. (a) The commissioner
1311 shall by rule adopt procedures for compliance with federal
1412 requirements relating to transition services for students who are
1513 enrolled in special education programs under this subchapter. The
1614 procedures must specify the manner in which a student's admission,
1715 review, and dismissal committee must consider, and if appropriate,
1816 address the following issues in the student's individualized
1917 education program:
2018 (1) appropriate student involvement in the student's
2119 transition to life outside the public school system;
2220 (2) if the student is younger than 18 years of age,
2321 appropriate [parental] involvement in the student's transition by
2422 the student's parents and other persons invited to participate by:
2523 (A) the student's parents; or
2624 (B) the school district in which the student is
2725 enrolled;
2826 (3) if the student is at least 18 years of age,
2927 [appropriate parental] involvement in the student's transition and
3028 future by the student's parents and other persons, if the parent or
3129 other person:
3230 (A) is invited to participate by the student or
3331 the school district in which the student is enrolled; or
3432 (B) has the student's consent to participate
3533 pursuant to a supported decision-making agreement under Chapter
3634 1357, Estates Code;
3735 (4) appropriate [any] postsecondary education
3836 options, including preparation for postsecondary-level coursework;
3937 (5) an appropriate [a] functional vocational
4038 evaluation;
4139 (6) appropriate employment goals and objectives;
4240 (7) if the student is at least 18 years of age, the
4341 availability of age-appropriate instructional environments,
4442 including community settings or environments that prepare the
4543 student for postsecondary education or training, competitive
4644 integrated employment, or independent living, in coordination with
4745 the student's transition goals and objectives;
4846 (8) appropriate independent living goals and
4947 objectives; [and]
5048 (9) appropriate circumstances for facilitating a
5149 referral of [referring] a student or the student's parents to a
5250 governmental agency for services or public benefits, including a
5351 referral to a governmental agency to place the student on a waiting
5452 list for public benefits available to the student, such as a waiver
5553 program established under Section 1915(c), Social Security Act (42
5654 U.S.C. Section 1396n(c)); and
5755 (10) the use and availability of appropriate:
5856 (A) supplementary aids, services, curricula, and
5957 other opportunities to assist the student in developing
6058 decision-making skills; and
6159 (B) supports and services to foster the student's
6260 independence and self-determination, including a supported
6361 decision-making agreement under Chapter 1357, Estates Code.
6462 (a-1) A student's admission, review, and dismissal
6563 committee shall annually review the issues described by Subsection
6664 (a) and, if necessary, update the portions of the student's
6765 individualized education program that address those issues.
6866 (a-2) The commissioner shall develop and post on the
6967 agency's Internet website a list of services and public benefits
7068 for which referral may be appropriate under Subsection (a)(9).
7169 (b) The commissioner shall require each school district
7270 or shared services arrangement to designate at least one employee
7371 to serve as the district's or shared services arrangement's
7472 designee on transition and employment services for students
7573 enrolled in special education programs under this subchapter. The
7674 commissioner shall develop minimum training guidelines for a
7775 district's or shared services arrangement's designee. An
7876 individual designated under this subsection must provide
7977 information and resources about effective transition planning and
8078 services, including each issue described by Subsection (a), and
8179 interagency coordination to ensure that local school staff
8280 communicate and collaborate with:
8381 (1) students enrolled in special education programs
8482 under this subchapter and the parents of those students; and
8583 (2) as appropriate, local and regional staff of the:
8684 (A) Health and Human Services Commission;
8785 (B) Texas Workforce Commission [Department of
8886 Aging and Disability Services];
8987 (C) [Department of Assistive and Rehabilitative
9088 Services;
9189 [(D)] Department of State Health Services; and
9290 (D) [(E)] Department of Family and Protective
9391 Services.
9492 (c) The commissioner shall review and, if necessary, update
9593 the minimum training guidelines developed under Subsection (b) at
9694 least once every four years. In reviewing and updating the
9795 guidelines, the commissioner shall solicit input from
9896 stakeholders.
9997 SECTION 2. Sections 29.0112(b) and (e), Education Code, are
10098 amended to read as follows:
10199 (b) The transition and employment guide must be written in
102100 plain language and contain information specific to this state
103101 regarding:
104102 (1) transition services;
105103 (2) employment and supported employment services;
106104 (3) social security programs;
107105 (4) community and long-term services and support,
108106 including the option to place the student on a waiting list with a
109107 governmental agency for public benefits available to the student,
110108 such as a waiver program established under Section 1915(c), Social
111109 Security Act (42 U.S.C. Section 1396n(c));
112110 (5) postsecondary educational programs and services,
113111 including the inventory maintained by the Texas Higher Education
114112 Coordinating Board under Section 61.0663;
115113 (6) information sharing with health and human services
116114 agencies and providers;
117115 (7) guardianship and alternatives to guardianship,
118116 including a supported decision-making agreement under Chapter
119117 1357, Estates Code;
120118 (8) self-advocacy, person-directed planning, and
121119 self-determination; and
122120 (9) contact information for all relevant state
123121 agencies.
124122 (e) A school district shall:
125123 (1) post the transition and employment guide on the
126124 district's website if the district maintains a website; [and]
127125 (2) provide written information and, if necessary,
128126 assistance to a student or parent regarding how to access the
129127 electronic version of the guide at:
130128 (A) the first meeting of the student's admission,
131129 review, and dismissal committee at which transition is discussed;
132130 and [or]
133131 (B) the first committee meeting at which
134132 transition is discussed that occurs after the date on which the
135133 guide is updated; and
136134 (3) on request, provide a printed copy of the guide to
137135 a student or parent [becomes available, if a student has already had
138136 an admission, review, and dismissal committee meeting discussing
139137 transition].
140138 SECTION 3. Section 29.017, Education Code, is amended by
141139 amending Subsections (c) and (d) and adding Subsections (c-1),
142140 (c-2), (c-3), (e), and (f) to read as follows:
143141 (c) Not later than one year before the 18th birthday of a
144142 student with a disability, the school district at which the student
145143 is enrolled shall:
146144 (1) provide to the student and the student's parents:
147145 (A) written notice regarding the transfer of
148146 rights under this section; and
149147 (B) information and resources regarding
150148 guardianship, alternatives to guardianship, including a supported
151149 decision-making agreement under Chapter 1357, Estates Code, and
152150 other supports and services that may enable the student to live
153151 independently; and
154152 (2) ensure that the student's individualized education
155153 program includes a statement that the district provided the notice,
156154 information, and resources required under Subdivision (1).
157155 (c-1) In accordance with 34 C.F.R. Section 300.520
158156 [300.517], the school district shall provide written notice to
159157 [notify] the student and the student's parents of the transfer of
160158 rights under this section. The notice must include the information
161159 and resources provided under Subsection (c)(1)(B).
162160 (c-2) If a student with a disability or the student's parent
163161 requests information regarding guardianship or alternatives to
164162 guardianship from the school district at which the student is
165163 enrolled, the school district shall provide to the student or
166164 parent information and resources on supported decision-making
167165 agreements under Chapter 1357, Estates Code.
168166 (c-3) The commissioner shall develop and post on the
169167 agency's Internet website a model form for use by school districts
170168 in notifying students and parents as required by Subsections (c)
171169 and (c-1). The form must include the information and resources
172170 described by Subsection (c). The commissioner shall review and
173171 update the form, including the information and resources, as
174172 necessary.
175173 (d) The commissioner shall develop and post on the agency's
176174 Internet website the information and resources described by
177175 Subsections (c), (c-1), and (c-2).
178176 (e) Nothing in this section prohibits a student from
179177 entering into a supported decision-making agreement under Chapter
180178 1357, Estates Code, after the transfer of rights under this
181179 section.
182180 (f) The commissioner shall adopt rules implementing the
183181 provisions of 34 C.F.R. Section 300.520(b) [300.517(b)].
184182 SECTION 4. This Act applies beginning with the 2018-2019
185183 school year.
186184 SECTION 5. This Act takes effect immediately if it receives
187185 a vote of two-thirds of all the members elected to each house, as
188186 provided by Section 39, Article III, Texas Constitution. If this
189187 Act does not receive the vote necessary for immediate effect, this
190188 Act takes effect September 1, 2017.
