64 AN ACT
75 relating to the composition of the Texas Historical Commission.
86 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
97 SECTION 1. Section 442.002(b), Government Code, is amended
108 to read as follows:
119 (b) The commission is composed of 15 [nine] members
1210 appointed by the governor with the advice and consent of the senate.
1311 One member must have expertise in archeology, preferably as a
1412 professional archeologist, one must have expertise in history,
1513 preferably as a professional historian, and one must have expertise
1614 in architecture, preferably as a professional architect who is
1715 licensed in this state and has expertise in historic preservation
1816 and architectural history. The remaining members must represent
1917 the general public. A person is [may] not eligible for appointment
2018 as [be] a member of the commission if the person or the person's
2119 spouse:
2220 (1) owns or controls, directly or indirectly, more
2321 than a 10 percent interest in a business entity or other
2422 organization regulated by the commission or receiving money other
2523 than grant money from the commission;
2624 (2) uses or receives a substantial amount of tangible
2725 goods, services, or money from the commission, other than
2826 compensation or reimbursement authorized by law for commission
2927 membership, attendance, or expenses; or
3028 (3) is employed by or participates in the management
3129 of a business entity or other organization regulated by or
3230 receiving money other than grant money from the commission.
3331 SECTION 2. As soon as practicable after the effective date
3432 of this Act, the governor shall appoint six additional members to
3533 the Texas Historical Commission as required by Section 442.002(b),
3634 Government Code, as amended by this Act. In appointing the
3735 additional members to the commission, the governor shall appoint:
3836 (1) two members, including one member with archeology
3937 expertise, to terms expiring February 1, 2019;
4038 (2) two members, including one member with history
4139 expertise, to terms expiring February 1, 2021; and
4240 (3) two members, including one member with
4341 architecture expertise, to terms expiring February 1, 2023.
4442 SECTION 3. This Act takes effect September 1, 2017.
