8 | 6 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 7 | | SECTION 1. Section 442.002(b), Government Code, is amended |
---|
10 | 8 | | to read as follows: |
---|
11 | 9 | | (b) The commission is composed of 15 [nine] members |
---|
12 | 10 | | appointed by the governor with the advice and consent of the senate. |
---|
13 | 11 | | One member must have expertise in archeology, preferably as a |
---|
14 | 12 | | professional archeologist, one must have expertise in history, |
---|
15 | 13 | | preferably as a professional historian, and one must have expertise |
---|
16 | 14 | | in architecture, preferably as a professional architect who is |
---|
17 | 15 | | licensed in this state and has expertise in historic preservation |
---|
18 | 16 | | and architectural history. The remaining members must represent |
---|
19 | 17 | | the general public. A person is [may] not eligible for appointment |
---|
20 | 18 | | as [be] a member of the commission if the person or the person's |
---|
21 | 19 | | spouse: |
---|
22 | 20 | | (1) owns or controls, directly or indirectly, more |
---|
23 | 21 | | than a 10 percent interest in a business entity or other |
---|
24 | 22 | | organization regulated by the commission or receiving money other |
---|
25 | 23 | | than grant money from the commission; |
---|
26 | 24 | | (2) uses or receives a substantial amount of tangible |
---|
27 | 25 | | goods, services, or money from the commission, other than |
---|
28 | 26 | | compensation or reimbursement authorized by law for commission |
---|
29 | 27 | | membership, attendance, or expenses; or |
---|
30 | 28 | | (3) is employed by or participates in the management |
---|
31 | 29 | | of a business entity or other organization regulated by or |
---|
32 | 30 | | receiving money other than grant money from the commission. |
---|
33 | 31 | | SECTION 2. As soon as practicable after the effective date |
---|
34 | 32 | | of this Act, the governor shall appoint six additional members to |
---|
35 | 33 | | the Texas Historical Commission as required by Section 442.002(b), |
---|
36 | 34 | | Government Code, as amended by this Act. In appointing the |
---|
37 | 35 | | additional members to the commission, the governor shall appoint: |
---|
38 | 36 | | (1) two members, including one member with archeology |
---|
39 | 37 | | expertise, to terms expiring February 1, 2019; |
---|
40 | 38 | | (2) two members, including one member with history |
---|
41 | 39 | | expertise, to terms expiring February 1, 2021; and |
---|
42 | 40 | | (3) two members, including one member with |
---|
43 | 41 | | architecture expertise, to terms expiring February 1, 2023. |

44 | 42 | | SECTION 3. This Act takes effect September 1, 2017. |
