14 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

15 | 10 | | SECTION 1. Subchapter B, Chapter 403, Government Code, is |
---|
16 | 11 | | amended by adding Section 403.0112 to read as follows: |
---|
17 | 12 | | Sec. 403.0112. ACCOUNTING FOR COSTS OF ILLEGAL IMMIGRATION. |
---|
18 | 13 | | (a) Not later than the 30th day before the first day of each |
---|
19 | 14 | | regular legislative session, the comptroller shall issue to the |
---|
20 | 15 | | speaker of the house of representatives, the lieutenant governor, |
---|
21 | 16 | | the governor, and the attorney general an estimation of the |
---|
22 | 17 | | financial costs to this state incurred during the preceding |
---|
23 | 18 | | two-year period that resulted from the presence in this state of |
---|
24 | 19 | | persons who are not lawfully present in the United States. |
---|
25 | 20 | | (b) The estimation must include a separate accounting for |
---|
26 | 21 | | the estimated costs to the state incurred in specific categories of |
---|
27 | 22 | | state spending as determined by the comptroller. The categories |
---|
28 | 23 | | must include costs of education of, health care for, and |
---|
29 | 24 | | incarceration of persons described by Subsection (a) and costs of |
---|
30 | 25 | | border security and law enforcement attributable to those persons. |
---|
31 | 26 | | SECTION 2. This state recognizes that it is the |
---|
32 | 27 | | responsibility of the federal government to maintain the security |
---|
33 | 28 | | of the national border to prevent unlawful entry of persons and |
---|
34 | 29 | | finds that the federal government should reimburse this state for |
---|
35 | 30 | | this state's expenditures that are made necessary for the same |
---|
36 | 31 | | purpose. |

37 | 32 | | SECTION 3. This Act takes effect September 1, 2017. |
