55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the authority of a code enforcement officer when
88 performing official duties to possess or carry an instrument used
99 for deterring the bite of an animal.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 46.15, Penal Code, is amended by adding
1212 Subsection (h) to read as follows:
1313 (h) The provisions of Sections 46.02 and 46.03 prohibiting
1414 the possession or carrying of a club do not apply to a code
1515 enforcement officer who:
1616 (1) holds a certificate of registration issued under
1717 Chapter 1952, Occupations Code; and
1818 (2) possesses or carries an instrument used
1919 specifically for deterring the bite of an animal while the officer
2020 is:
2121 (A) performing official duties; or
2222 (B) traveling to or from a place of duty.
2323 SECTION 2. Section 1952.051, Occupations Code, as effective
2424 September 1, 2017, is amended by adding Subsection (c) to read as
2525 follows:
2626 (c) The education requirements adopted under Subsection (b)
2727 must include education regarding the principles and procedures to
2828 be followed when possessing or carrying an instrument used
2929 specifically for deterring the bite of an animal.
3030 SECTION 3. Section 1952.1051, Occupations Code, as
3131 effective September 1, 2017, is amended to read as follows:
3232 Sec. 1952.1051. CONTINUING EDUCATION. The commission by
3333 rule shall prescribe continuing education requirements for code
3434 enforcement officers and code enforcement officers in training
3535 that:
3636 (1) establish the number of hours of continuing
3737 education required for renewal of a certificate of registration;
3838 (2) establish an approved curriculum that includes
3939 material regarding changes in applicable law and the principles and
4040 procedures to be followed when possessing or carrying an instrument
4141 used specifically for deterring the bite of an animal; and
4242 (3) provide that the approved curriculum may be taught
4343 by suitable public agencies and by private entities approved by the
4444 department.
4545 SECTION 4. This Act takes effect September 1, 2017.
