| 7 | 7 | | relating to the authority of a code enforcement officer when |
|---|
| 8 | 8 | | performing official duties to possess or carry an instrument used |
|---|
| 9 | 9 | | for deterring the bite of an animal. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 46.15, Penal Code, is amended by adding |
|---|
| 12 | 12 | | Subsection (h) to read as follows: |
|---|
| 13 | 13 | | (h) The provisions of Sections 46.02 and 46.03 prohibiting |
|---|
| 14 | 14 | | the possession or carrying of a club do not apply to a code |
|---|
| 15 | 15 | | enforcement officer who: |
|---|
| 16 | 16 | | (1) holds a certificate of registration issued under |
|---|
| 17 | 17 | | Chapter 1952, Occupations Code; and |
|---|
| 18 | 18 | | (2) possesses or carries an instrument used |
|---|
| 19 | 19 | | specifically for deterring the bite of an animal while the officer |
|---|
| 20 | 20 | | is: |
|---|
| 21 | 21 | | (A) performing official duties; or |
|---|
| 22 | 22 | | (B) traveling to or from a place of duty. |
|---|
| 23 | 23 | | SECTION 2. Section 1952.051, Occupations Code, as effective |
|---|
| 24 | 24 | | September 1, 2017, is amended by adding Subsection (c) to read as |
|---|
| 25 | 25 | | follows: |
|---|
| 26 | 26 | | (c) The education requirements adopted under Subsection (b) |
|---|
| 27 | 27 | | must include education regarding the principles and procedures to |
|---|
| 28 | 28 | | be followed when possessing or carrying an instrument used |
|---|
| 29 | 29 | | specifically for deterring the bite of an animal. |
|---|
| 30 | 30 | | SECTION 3. Section 1952.1051, Occupations Code, as |
|---|
| 31 | 31 | | effective September 1, 2017, is amended to read as follows: |
|---|
| 32 | 32 | | Sec. 1952.1051. CONTINUING EDUCATION. The commission by |
|---|
| 33 | 33 | | rule shall prescribe continuing education requirements for code |
|---|
| 34 | 34 | | enforcement officers and code enforcement officers in training |
|---|
| 35 | 35 | | that: |
|---|
| 36 | 36 | | (1) establish the number of hours of continuing |
|---|
| 37 | 37 | | education required for renewal of a certificate of registration; |
|---|
| 38 | 38 | | (2) establish an approved curriculum that includes |
|---|
| 39 | 39 | | material regarding changes in applicable law and the principles and |
|---|
| 40 | 40 | | procedures to be followed when possessing or carrying an instrument |
|---|
| 41 | 41 | | used specifically for deterring the bite of an animal; and |
|---|
| 42 | 42 | | (3) provide that the approved curriculum may be taught |
|---|
| 43 | 43 | | by suitable public agencies and by private entities approved by the |
|---|
| 44 | 44 | | department. |
|---|
| 45 | 45 | | SECTION 4. This Act takes effect September 1, 2017. |
