99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to the indigent status of a person for the purposes of the
1212 driver responsibility program.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 708.158(a), Transportation Code, is
1515 amended to read as follows:
1616 (a) The department shall waive all surcharges assessed
1717 under this chapter for a person who is indigent. For the purposes
1818 of this section, a person is considered to be indigent if the person
1919 provides the evidence described by Subsection (b) to the court. The
2020 court on its own motion may inquire whether the person would like to
2121 submit evidence to establish the person's indigent status.
2222 SECTION 2. The change in law made by this Act to Section
2323 708.158, Transportation Code, applies only to a trial that begins
2424 on or after the effective date of this Act, regardless of whether
2525 the offense occurred before, on, or after the effective date of this
2626 Act. The state is not required to refund a surcharge collected
2727 before the effective date of this Act.
2828 SECTION 3. This Act takes effect immediately if it receives
2929 a vote of two-thirds of all the members elected to each house, as
3030 provided by Section 39, Article III, Texas Constitution. If this
3131 Act does not receive the vote necessary for immediate effect, this
3232 Act takes effect September 1, 2017.
