1111 A BILL TO BE ENTITLED
1212 AN ACT
1313 relating to restrictions on the location and operation of concrete
1414 crushing facilities.
1515 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1616 SECTION 1. Section 382.065, Health and Safety Code, is
1717 amended by amending Subsections (a) and (b) and adding Subsections
1818 (a-1) and (a-2) to read as follows:
1919 (a) The commission by rule shall prohibit the operation of a
2020 concrete crushing facility within 440 yards of the following types
2121 of buildings or facilities:
2222 (1) a building in use as a single or multifamily
2323 residence, school, or place of worship;
2424 (2) an area designated as a public park by action of a
2525 governmental entity; or
2626 (3) after notice is given to the operator of the
2727 concrete crushing facility, an outdoor recreational facility used
2828 for organized sporting events during the time the recreational
2929 facility is used for those events [at the time the application for a
3030 permit to operate the facility at a site near the residence, school,
3131 or place of worship is filed with the commission].
3232 (a-1) Rules adopted under this section must provide for the
3333 manner and time of giving notice to an operator of a concrete
3434 crushing facility under Subsection (a)(3).
3535 (a-2) The measurement of distance for purposes of this
3636 section is the shortest distance between [subsection shall be taken
3737 from the point on] the concrete crushing facility and a building,
3838 public park, or outdoor recreational facility described by
3939 Subsection (a) [that is nearest to the residence, school, or place
4040 of worship toward the point on the residence, school, or place of
4141 worship that is nearest the concrete crushing facility].
4242 (b) A rule adopted under this section [Subsection (a)] does
4343 not apply to a concrete crushing facility:
4444 (1) at a location for which commission authorization
4545 for the operation of a concrete crushing facility was in effect on
4646 September 1, 2001;
4747 (2) at a location that satisfies the distance
4848 requirements of Subsection (a) at the time the application for the
4949 initial authorization for the operation of that facility at that
5050 location is filed with the commission, provided that the
5151 authorization is granted and maintained, regardless of whether a
5252 building, public park, or outdoor recreational facility described
5353 by Subsection (a) [single or multifamily residence, school, or
5454 place of worship] is subsequently built or put to use within 440
5555 yards of the facility; or
5656 (3) that:
5757 (A) uses a concrete crusher:
5858 (i) in the manufacture of products that
5959 contain recycled materials; and
6060 (ii) that is located in an enclosed
6161 building; and
6262 (B) is located:
6363 (i) within 25 miles of an international
6464 border; and
6565 (ii) in a municipality with a population of
6666 not less than 6,100 but not more than 20,000.
6767 SECTION 2. The change in law made by this Act applies only
6868 to an application for a permit to operate a concrete crushing
6969 facility that is filed on or after the effective date of this Act.
7070 An application for a permit filed before the effective date of this
7171 Act is governed by the law in effect on the date of filing, and that
7272 law is continued in effect for that purpose.
7373 SECTION 3. This Act takes effect immediately if it receives
7474 a vote of two-thirds of all the members elected to each house, as
7575 provided by Section 39, Article III, Texas Constitution. If this
7676 Act does not receive the vote necessary for immediate effect, this
7777 Act takes effect September 1, 2017.
