| 10 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 9 | | SECTION 1. Section 39.0261(a), Education Code, is amended |
|---|
| 12 | 10 | | to read as follows: |
|---|
| 13 | 11 | | (a) In addition to the assessment instruments otherwise |
|---|
| 14 | 12 | | authorized or required by this subchapter: |
|---|
| 15 | 13 | | (1) each school year and at state cost, a school |
|---|
| 16 | 14 | | district may [shall] administer to students in the spring of the |
|---|
| 17 | 15 | | eighth grade an established, valid, reliable, and nationally |
|---|
| 18 | 16 | | norm-referenced preliminary college preparation assessment |
|---|
| 19 | 17 | | instrument for the purpose of diagnosing the academic strengths and |
|---|
| 20 | 18 | | deficiencies of students before entrance into high school; |
|---|
| 21 | 19 | | (2) each school year and at state cost, a school |
|---|
| 22 | 20 | | district may [shall] administer to students in the 10th grade an |
|---|
| 23 | 21 | | established, valid, reliable, and nationally norm-referenced |
|---|
| 24 | 22 | | preliminary college preparation assessment instrument for the |
|---|
| 25 | 23 | | purpose of measuring a student's progress toward readiness for |
|---|
| 26 | 24 | | college and the workplace; and |
|---|
| 27 | 25 | | (3) high school students in the spring of the 11th |
|---|
| 28 | 26 | | grade or during the 12th grade may select and take once, at state |
|---|
| 29 | 27 | | cost, one of the valid, reliable, and nationally norm-referenced |
|---|
| 30 | 28 | | assessment instruments used by colleges and universities as part of |
|---|
| 31 | 29 | | their undergraduate admissions processes. |
|---|
| 32 | 30 | | SECTION 2. This Act applies beginning with the 2017-2018 |
|---|
| 33 | 31 | | school year. |
|---|
| 34 | 32 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 35 | 33 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 36 | 34 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 37 | 35 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 38 | 36 | | Act takes effect September 1, 2017. |
