75 relating to school district discretion to administer college
86 preparation assessment instruments to public school students at

108 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
119 SECTION 1. Section 39.0261(a), Education Code, is amended
1210 to read as follows:
1311 (a) In addition to the assessment instruments otherwise
1412 authorized or required by this subchapter:
1513 (1) each school year and at state cost, a school
1614 district may [shall] administer to students in the spring of the
1715 eighth grade an established, valid, reliable, and nationally
1816 norm-referenced preliminary college preparation assessment
1917 instrument for the purpose of diagnosing the academic strengths and
2018 deficiencies of students before entrance into high school;
2119 (2) each school year and at state cost, a school
2220 district may [shall] administer to students in the 10th grade an
2321 established, valid, reliable, and nationally norm-referenced
2422 preliminary college preparation assessment instrument for the
2523 purpose of measuring a student's progress toward readiness for
2624 college and the workplace; and
2725 (3) high school students in the spring of the 11th
2826 grade or during the 12th grade may select and take once, at state
2927 cost, one of the valid, reliable, and nationally norm-referenced
3028 assessment instruments used by colleges and universities as part of
3129 their undergraduate admissions processes.
3230 SECTION 2. This Act applies beginning with the 2017-2018
3331 school year.
3432 SECTION 3. This Act takes effect immediately if it receives
3533 a vote of two-thirds of all the members elected to each house, as
3634 provided by Section 39, Article III, Texas Constitution. If this
3735 Act does not receive the vote necessary for immediate effect, this
3836 Act takes effect September 1, 2017.
