114 A BILL TO BE ENTITLED
125 AN ACT
136 relating to requirements for student elections to authorize or
147 increase certain fees at public institutions of higher education.
158 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
169 SECTION 1. Subchapter E, Chapter 54, Education Code, is
1710 amended by adding Section 54.5001 to read as follows:
1811 Sec. 54.5001. PARTICIPATION REQUIREMENTS FOR STUDENT FEE
1912 ELECTIONS. Notwithstanding any other provision of this subchapter
2013 or other law, a general student election held at a general academic
2114 teaching institution under this subchapter for the purpose of
2215 authorizing a student fee or approving an increase in the amount of
2316 an existing student fee is not valid unless:
2417 (1) at least 10 percent of the students enrolled at the
2518 institution to whom the fee, or the increased amount of the fee,
2619 would apply if currently in effect participate in the election; and
2720 (2) at least 30 percent of the students participating
2821 in the election are students enrolled in lower-division courses at
2922 the institution.
3023 SECTION 2. Section 54.5001, Education Code, as added by
3124 this Act, applies only to an election held to authorize the
3225 imposition of a fee or fee increase on or after the effective date
3326 of this Act.
3427 SECTION 3. This Act takes effect September 1, 2017.
