| 15 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 16 | 9 | | SECTION 1. Subchapter E, Chapter 54, Education Code, is |
|---|
| 17 | 10 | | amended by adding Section 54.5001 to read as follows: |
|---|
| 18 | 11 | | Sec. 54.5001. PARTICIPATION REQUIREMENTS FOR STUDENT FEE |
|---|
| 19 | 12 | | ELECTIONS. Notwithstanding any other provision of this subchapter |
|---|
| 20 | 13 | | or other law, a general student election held at a general academic |
|---|
| 21 | 14 | | teaching institution under this subchapter for the purpose of |
|---|
| 22 | 15 | | authorizing a student fee or approving an increase in the amount of |
|---|
| 23 | 16 | | an existing student fee is not valid unless: |
|---|
| 24 | 17 | | (1) at least 10 percent of the students enrolled at the |
|---|
| 25 | 18 | | institution to whom the fee, or the increased amount of the fee, |
|---|
| 26 | 19 | | would apply if currently in effect participate in the election; and |
|---|
| 27 | 20 | | (2) at least 30 percent of the students participating |
|---|
| 28 | 21 | | in the election are students enrolled in lower-division courses at |
|---|
| 29 | 22 | | the institution. |
|---|
| 30 | 23 | | SECTION 2. Section 54.5001, Education Code, as added by |
|---|
| 31 | 24 | | this Act, applies only to an election held to authorize the |
|---|
| 32 | 25 | | imposition of a fee or fee increase on or after the effective date |
|---|
| 33 | 26 | | of this Act. |
|---|
| 34 | 27 | | SECTION 3. This Act takes effect September 1, 2017. |
