| 15 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 16 | 9 | | SECTION 1. Chapter 330, Local Government Code, is amended |
|---|
| 17 | 10 | | by adding Section 330.002 to read as follows: |

| 18 | 11 | | Sec. 330.002. LIMITATION ON AUTHORITY OF CERTAIN COUNTIES |
|---|
| 19 | 12 | | TO IMPROVE OR REDEVELOP CERTAIN SPORTS FACILITIES. (a) In this |

| 20 | 13 | | section: |
|---|
| 21 | 14 | | (1) "County revenue" includes revenue from property |
|---|
| 22 | 15 | | taxes, hotel occupancy taxes, fees, and fines. |
|---|
| 23 | 16 | | (2) "Obsolete sports facility" means a multipurpose |
|---|
| 24 | 17 | | arena, coliseum, or stadium designed to be used in part as a venue |
|---|
| 25 | 18 | | for professional sports events and that opened to the public before |
|---|
| 26 | 19 | | 1966. |
|---|
| 27 | 20 | | (b) This section applies only to a county with a population |
|---|
| 28 | 21 | | of 3.3 million or more. |
|---|
| 29 | 22 | | (c) A county may not fund, in whole or in part, the |
|---|
| 30 | 23 | | improvement or redevelopment of an obsolete sports facility with |
|---|
| 31 | 24 | | county revenue or debt if the improvement or redevelopment will |
|---|
| 32 | 25 | | cost $10 million or more, unless the funding is approved by the |
|---|
| 33 | 26 | | voters of the county at an election held for that purpose. |
|---|
| 34 | 27 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 35 | 28 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 36 | 29 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 37 | 30 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 38 | 31 | | Act takes effect September 1, 2017. |
