13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

14 | 14 | | SECTION 1. Subchapter B, Chapter 112, Transportation Code, |
---|
15 | 15 | | is amended by adding Section 112.063 to read as follows: |
---|
16 | 16 | | Sec. 112.063. HIGH-SPEED RAIL TECHNOLOGIES. (a) In this |
---|
17 | 17 | | section: |
---|
18 | 18 | | (1) "High-speed rail" means intercity passenger |
---|
19 | 19 | | service that is reasonably expected to reach speeds of at least 110 |
---|
20 | 20 | | miles per hour. |
---|
21 | 21 | | (2) "Rail facility" has the meaning assigned by |
---|
22 | 22 | | Section 91.001. |
---|
23 | 23 | | (b) A private entity that constructs a rail facility for |
---|
24 | 24 | | high-speed rail service shall ensure that the facility is |
---|
25 | 25 | | compatible with more than one type of train technology. |
---|
26 | 26 | | (c) The department shall adopt rules as necessary to |
---|
27 | 27 | | implement this section. |
---|
28 | 28 | | SECTION 2. This Act takes effect September 1, 2017. |
