55 A JOINT RESOLUTION
66 proposing a constitutional amendment providing that members of the
77 legislature and the lieutenant governor will not receive a state
88 salary or per diem during certain periods unless the legislature
99 has passed the state's budget and that budget is certified by the
1010 comptroller.
1111 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 24, Article III, Texas Constitution, is
1313 amended by adding Subsection (d) to read as follows:
1414 (d) This subsection applies only if the Comptroller of
1515 Public Accounts has not certified, as provided by Section 49a(b) of
1616 this article, before the 31st day after the last day of a Regular
1717 Session of the Legislature, a general appropriations act that
1818 constitutes this State's budget for the succeeding State fiscal
1919 biennium. Notwithstanding Subsections (a) and (c) of this section
2020 and Section 17(b), Article IV, of this constitution, a Member of the
2121 Legislature and the Lieutenant Governor while acting as President
2222 of the Senate are not entitled to receive any salary or per diem to
2323 which those Officers would otherwise be entitled for the period
2424 beginning on the 31st day after the last day of a Regular Session of
2525 the Legislature and ending at the end of the day preceding the day
2626 the Comptroller certifies a general appropriations act that
2727 constitutes this State's budget for that succeeding State fiscal
2828 biennium.
2929 SECTION 2. The following temporary provision is added to
3030 the Texas Constitution:
3131 TEMPORARY PROVISION. (a) This temporary provision applies
3232 to the constitutional amendment proposed by the 85th Legislature,
3333 Regular Session, 2017, to provide that members of the legislature
3434 and the lieutenant governor will not receive a state salary or per
3535 diem during certain periods unless the legislature has passed the
3636 state's budget and that budget is certified by the comptroller.
3737 (b) Section 24(d), Article III, of this constitution
3838 applies only in relation to the certification of a general
3939 appropriations act that constitutes this state's budget for a state
4040 fiscal biennium beginning on or after September 1, 2019.
4141 (c) This temporary provision expires September 1, 2020.
4242 SECTION 3. This proposed constitutional amendment shall be
4343 submitted to the voters at an election to be held November 7, 2017.
4444 The ballot shall be printed to permit voting for or against the
4545 proposition: "The constitutional amendment providing that members
4646 of the legislature and the lieutenant governor will not receive a
4747 state salary or per diem during certain periods unless the
4848 legislature has passed the state's budget and that budget is
4949 certified by the comptroller."
