9 | 9 | | has passed the state's budget and that budget is certified by the |
---|
10 | 10 | | comptroller. |

11 | 11 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
12 | 12 | | SECTION 1. Section 24, Article III, Texas Constitution, is |
---|
13 | 13 | | amended by adding Subsection (d) to read as follows: |
---|
14 | 14 | | (d) This subsection applies only if the Comptroller of |
---|
15 | 15 | | Public Accounts has not certified, as provided by Section 49a(b) of |
---|
16 | 16 | | this article, before the 31st day after the last day of a Regular |
---|
17 | 17 | | Session of the Legislature, a general appropriations act that |
---|
18 | 18 | | constitutes this State's budget for the succeeding State fiscal |
---|
19 | 19 | | biennium. Notwithstanding Subsections (a) and (c) of this section |
---|
20 | 20 | | and Section 17(b), Article IV, of this constitution, a Member of the |
---|
21 | 21 | | Legislature and the Lieutenant Governor while acting as President |
---|
22 | 22 | | of the Senate are not entitled to receive any salary or per diem to |
---|
23 | 23 | | which those Officers would otherwise be entitled for the period |
---|
24 | 24 | | beginning on the 31st day after the last day of a Regular Session of |
---|
25 | 25 | | the Legislature and ending at the end of the day preceding the day |
---|
26 | 26 | | the Comptroller certifies a general appropriations act that |
---|
27 | 27 | | constitutes this State's budget for that succeeding State fiscal |
---|
28 | 28 | | biennium. |
---|
29 | 29 | | SECTION 2. The following temporary provision is added to |
---|
30 | 30 | | the Texas Constitution: |
---|
31 | 31 | | TEMPORARY PROVISION. (a) This temporary provision applies |
---|
32 | 32 | | to the constitutional amendment proposed by the 85th Legislature, |
---|
33 | 33 | | Regular Session, 2017, to provide that members of the legislature |
---|
34 | 34 | | and the lieutenant governor will not receive a state salary or per |
---|
35 | 35 | | diem during certain periods unless the legislature has passed the |
---|
36 | 36 | | state's budget and that budget is certified by the comptroller. |
---|
37 | 37 | | (b) Section 24(d), Article III, of this constitution |
---|
38 | 38 | | applies only in relation to the certification of a general |
---|
39 | 39 | | appropriations act that constitutes this state's budget for a state |
---|
40 | 40 | | fiscal biennium beginning on or after September 1, 2019. |
---|
41 | 41 | | (c) This temporary provision expires September 1, 2020. |
---|
42 | 42 | | SECTION 3. This proposed constitutional amendment shall be |
---|
43 | 43 | | submitted to the voters at an election to be held November 7, 2017. |
---|
44 | 44 | | The ballot shall be printed to permit voting for or against the |
---|
45 | 45 | | proposition: "The constitutional amendment providing that members |
---|
46 | 46 | | of the legislature and the lieutenant governor will not receive a |
---|
47 | 47 | | state salary or per diem during certain periods unless the |
---|
48 | 48 | | legislature has passed the state's budget and that budget is |
---|
49 | 49 | | certified by the comptroller." |
