7		-	A JOINT RESOLUTION
8	4		rescinding certain applications made by the Texas Legislature to
9	5		the United States Congress to call a national convention under
10	6		Article V of the United States Constitution for proposing any
11	7		amendment to that Constitution.
12	8		WHEREAS, Over the years, the Texas Legislature has approved
13	9		resolutions officially applying to the Congress of the United
14	10		States to call a convention, under the terms of Article V of the
15	11		Constitution of the United States, to offer various amendments to
16	12		that Constitution; and
17	13		WHEREAS, While no Article V amendatory convention has yet
18	14		taken place thus far in American history, nevertheless, there is a
19	15		very real possibility that one, or more than one, could be triggered
20	16		at some point in the future; and
21	17		WHEREAS, Regardless of their age, such past applications from
22	18		Texas lawmakers remain alive and valid until such time as they are
23	19		later formally rescinded; now, therefore, be it
24	20		RESOLVED, That the 85th Legislature of the State of Texas,
25	21		Regular Session, 2017, hereby officially rescinds, repeals,
26	22		revokes, cancels, voids, and nullifies any and all applications
27	23		from Texas legislators prior to the 85th Legislature, Regular
28	24		Session, 2017, other than the application provided by H.C.R.
29	25		No. 31, Acts of the 65th Legislature, Regular Session, 1977, that
30	26		apply to the United States Congress for the calling of a convention,
31	27		pursuant to Article V of the United States Constitution, regardless
32	28		of how old such previous applications might be, and irrespective of
33	29		what subject matters such applications pertained to; and, be it
34	30		further
35	31		RESOLVED, That the 85th Legislature of the State of Texas,
36	32		Regular Session, 2017, hereby declares that any application to the
37	33		United States Congress for the calling of a convention under
38	34		Article V of the United States Constitution that is submitted by the
39	35		Texas Legislature during or after this Regular Session shall be
40	36		automatically rescinded, repealed, revoked, canceled, voided, and
41	37		nullified if the applicable convention is not called on or before
42	38		the eighth anniversary of the date the last legislative vote is
43	39		taken on the application; and, be it further
44	40		RESOLVED, That, in a manner which would furnish confirmation
45	41		of delivery and tracking while en route, the Texas secretary of
46	42		state shall transmit properly certified copies of this joint
47	43		resolution of rescission, pursuant to the Standing Rules of the
48	44		United States Senate (namely, Rule VII, paragraphs 4, 5, and 6), to
49	45		the vice president of the United States (in his capacity as
50	46		presiding officer of the United States Senate and addressed to him
51	47		at the office which he maintains inside the United States Capitol
52	48		Building); to the secretary and parliamentarian of the United
53	49		States Senate; and to both United States senators representing
54	50		Texas; accompanied by a cover letter to each addressee drawing
55	51		attention to the fact that it is the 85th Texas Legislature's
56	52		courteous, yet firm, request that the full and complete verbatim
57	53		text of this joint resolution be duly published in the United States
58	54		Senate's portion of the Congressional Record as an official
59	55		memorial to the United States Senate, and that this joint
60	56		resolution be referred to whichever committee or committees of the
61	57		United States Senate that would have appropriate jurisdiction in
62	58		this matter; and, be it further
63	59		RESOLVED, That, in a manner which would furnish confirmation
64	60		of delivery and tracking while en route, the Texas secretary of
65	61		state shall likewise transmit properly certified copies of this
66	62		joint resolution of rescission, pursuant to the Rules of the United
67	63		States House of Representatives (namely, Rule XII, clauses 3 and
68	64		7), to the speaker, clerk, and parliamentarian of the United States
69	65		House of Representatives; and to all members of the United States
70	66		House of Representatives who represent districts in Texas; likewise
71	67		accompanied by a cover letter to each addressee drawing attention
72	68		to the fact that it is the 85th Texas Legislature's courteous, yet
73	69		firm, request that the substance of this joint resolution be
74	70		accurately summarized in the United States House of
75	71		Representatives' portion of the Congressional Record as an official
76	72		memorial to the United States House of Representatives, and that
77	73		this joint resolution be referred to whichever committee or
78	74		committees of the United States House of Representatives that would
79	75		have appropriate jurisdiction in this matter.
