| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. The heading to Chapter 250, Local Government |
|---|
| 12 | 12 | | Code, is amended to read as follows: |
|---|
| 13 | 13 | | CHAPTER 250. MISCELLANEOUS REGULATORY AUTHORITY OF MORE THAN ONE |
|---|
| 14 | 14 | | TYPE OF LOCAL GOVERNMENT [MUNICIPALITIES AND COUNTIES] |

| 15 | 15 | | SECTION 2. Chapter 250, Local Government Code, is amended |

| 16 | 16 | | by adding Section 250.009 to read as follows: |

| 17 | 17 | | Sec. 250.009. LIMITATION ON AUTHORITY TO REGULATE CERTAIN |

| 18 | 18 | | BUILDERS OR CONTRACTORS. A political subdivision may not adopt or |
|---|
| 19 | 19 | | enforce an ordinance, order, or other measure that requires a |
|---|
| 20 | 20 | | builder or contractor to obtain an occupational license or other |
|---|
| 21 | 21 | | form of certification from the political subdivision as a condition |
|---|
| 22 | 22 | | of obtaining a building permit or other authorization to construct |
|---|
| 23 | 23 | | or remodel a commercial structure. |

| 24 | 24 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 25 | 25 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 26 | 26 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 27 | 27 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 28 | 28 | | Act takes effect December 1, 2017. |
