66 AN ACT
77 relating to the authority of a political subdivision to adopt or
88 enforce a requirement that a builder or contractor obtain a license
99 or other similar certification from the political subdivision.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. The heading to Chapter 250, Local Government
1212 Code, is amended to read as follows:
1313 CHAPTER 250. MISCELLANEOUS REGULATORY AUTHORITY OF MORE THAN ONE
1414 TYPE OF LOCAL GOVERNMENT [MUNICIPALITIES AND COUNTIES]
1515 SECTION 2. Chapter 250, Local Government Code, is amended
1616 by adding Section 250.009 to read as follows:
1717 Sec. 250.009. LIMITATION ON AUTHORITY TO REGULATE CERTAIN
1818 BUILDERS OR CONTRACTORS. A political subdivision may not adopt or
1919 enforce an ordinance, order, or other measure that requires a
2020 builder or contractor to obtain an occupational license or other
2121 form of certification from the political subdivision as a condition
2222 of obtaining a building permit or other authorization to construct
2323 or remodel a commercial structure.
2424 SECTION 3. This Act takes effect immediately if it receives
2525 a vote of two-thirds of all the members elected to each house, as
2626 provided by Section 39, Article III, Texas Constitution. If this
2727 Act does not receive the vote necessary for immediate effect, this
2828 Act takes effect December 1, 2017.
