5	5		A BILL TO BE ENTITLED
6	6		AN ACT
7	7		relating to reimbursement rates for Medicaid acute care therapy
8	8		services; making an appropriation.
9	9		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10		SECTION 1. (a) In addition to other amounts appropriated to
11	11		the Health and Human Services Commission for the state fiscal
12	12		biennium ending August 31, 2019, the following amounts are
13	13		appropriated to the commission for Medicaid acute care therapy
14	14		services for the specified periods:
15	15		(1) $34,180,000 from the economic stabilization fund
16	16		and $44,977,018 from federal funds for the state fiscal year ending
17	17		August 31, 2018; and
18	18		(2) $35,995,000 from the economic stabilization fund
19	19		and $48,262,959 from federal funds for the state fiscal year ending
20	20		August 31, 2019.
21	21		(b) It is the intent of the legislature that:
22	22		(1) the Health and Human Services Commission allocate
23	23		money appropriated under Subsection (a) of this section among
24	24		provider types and procedure codes for Medicaid acute care therapy
25	25		services in a manner that preserves access to care for clients
26	26		served under the Medicaid fee-for-service and managed care delivery
27	27		models; and
28	28		(2) money appropriated under Subsection (a) of this
29	29		section be fully reflected in reimbursement rates paid to Medicaid
30	30		acute care therapy services providers under both the Medicaid
31	31		fee-for-service and managed care delivery models.
32		-	SECTION 2. The appropriation from the economic
33		-	stabilization fund to the Trusteed Programs within the Office of
34		-	the Governor for Strategy A.1.1., Disaster Funds, made by Chapter
35		-	605 (S.B. 1), Acts of the 85th Legislature, Regular Session, 2017
36		-	(the General Appropriations Act), for the state fiscal biennium
37		-	beginning September 1, 2017, is reduced by $70,175,000.
38		-	SECTION 3. (a) Subject to Subsection (b) of this section:

39	33		(1) this Act takes effect immediately if it receives a
40	34		vote of two-thirds of all the members elected to each house, as
41	35		provided by Section 39, Article III, Texas Constitution; and
42	36		(2) if this Act does not receive the vote necessary for
43	37		immediate effect, this Act takes effect on the 91st day after the
44	38		last day of the legislative session.
45	39		(b) This Act takes effect only if it receives a vote of
46	40		two-thirds of the members present in each house of the legislature,
47	41		as provided by Section 49-g(m), Article III, Texas Constitution.
