55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to reimbursement rates for Medicaid acute care therapy
88 services; making an appropriation.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. (a) In addition to other amounts appropriated to
1111 the Health and Human Services Commission for the state fiscal
1212 biennium ending August 31, 2019, the following amounts are
1313 appropriated to the commission for Medicaid acute care therapy
1414 services for the specified periods:
1515 (1) $34,180,000 from the economic stabilization fund
1616 and $44,977,018 from federal funds for the state fiscal year ending
1717 August 31, 2018; and
1818 (2) $35,995,000 from the economic stabilization fund
1919 and $48,262,959 from federal funds for the state fiscal year ending
2020 August 31, 2019.
2121 (b) It is the intent of the legislature that:
2222 (1) the Health and Human Services Commission allocate
2323 money appropriated under Subsection (a) of this section among
2424 provider types and procedure codes for Medicaid acute care therapy
2525 services in a manner that preserves access to care for clients
2626 served under the Medicaid fee-for-service and managed care delivery
2727 models; and
2828 (2) money appropriated under Subsection (a) of this
2929 section be fully reflected in reimbursement rates paid to Medicaid
3030 acute care therapy services providers under both the Medicaid
3131 fee-for-service and managed care delivery models.
32- SECTION 2. The appropriation from the economic
33- stabilization fund to the Trusteed Programs within the Office of
34- the Governor for Strategy A.1.1., Disaster Funds, made by Chapter
35- 605 (S.B. 1), Acts of the 85th Legislature, Regular Session, 2017
36- (the General Appropriations Act), for the state fiscal biennium
37- beginning September 1, 2017, is reduced by $70,175,000.
38- SECTION 3. (a) Subject to Subsection (b) of this section:

3933 (1) this Act takes effect immediately if it receives a
4034 vote of two-thirds of all the members elected to each house, as
4135 provided by Section 39, Article III, Texas Constitution; and
4236 (2) if this Act does not receive the vote necessary for
4337 immediate effect, this Act takes effect on the 91st day after the
4438 last day of the legislative session.
4539 (b) This Act takes effect only if it receives a vote of
4640 two-thirds of the members present in each house of the legislature,
4741 as provided by Section 49-g(m), Article III, Texas Constitution.
