| 11 | 11 | SECTION 1. Subchapter Z, Chapter 212, Local Government | |
| 12 | 12 | Code, is amended by adding Section 212.905 to read as follows: | |
| 13 | 13 | Sec. 212.905. OPTIONAL FEE IN LIEU OF PARKLAND DEDICATION. | |
| 14 | 14 | A municipality that requires a dedication of parkland as a | |
| 15 | 15 | condition of approving an application for the development of or the | |
| 16 | 16 | use of real property must allow the applicant to pay an optional fee | |
| 17 | 17 | to the municipality in lieu of the dedication. | |
| 18 | 18 | SECTION 2. Section 212.905, Local Government Code, as added | |
| 19 | 19 | by this Act, applies only to an application for the development or | |
| 20 | 20 | use of land submitted to a municipality for approval on or after the | |
| 21 | 21 | effective date of this Act. | |
| 22 | 22 | SECTION 3. This Act takes effect December 1, 2017. |
