A BILL TO BE ENTITLED
AN ACT
relating to an optional fee in lieu of the dedication of parkland as
a condition of approval by a municipality of land development or
use.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter Z, Chapter 212, Local Government
Code, is amended by adding Section 212.905 to read as follows:
Sec. 212.905. OPTIONAL FEE IN LIEU OF PARKLAND DEDICATION.
A municipality that requires a dedication of parkland as a
condition of approving an application for the development of or the
use of real property must allow the applicant to pay an optional fee
to the municipality in lieu of the dedication.
SECTION 2. Section 212.905, Local Government Code, as added
by this Act, applies only to an application for the development or
use of land submitted to a municipality for approval on or after the
effective date of this Act.
SECTION 3. This Act takes effect December 1, 2017.
