55 A JOINT RESOLUTION
66 proposing a constitutional amendment prohibiting the authorization
77 or funding of an elementary or secondary education voucher program
88 or similar program.
99 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Article VII, Texas Constitution, is amended by
1111 adding Section 7 to read as follows:
1212 Sec. 7. (a) In this section, "private school" means a
1313 nongovernmental educational establishment that exists for the
1414 general education of elementary or secondary students.
1515 (b) The legislature may not appropriate money for or
1616 authorize a voucher program, education savings account, tax credit
1717 scholarship program, or similar program under which state revenue
1818 is used to pay all or any part of the costs of a student's attendance
1919 at a private school.
2020 (c) This section does not prohibit the use of state revenue
2121 to pay all or any part of the costs of attendance at a private school
2222 by a student with a disability if the student is entitled under
2323 federal law to receive special education services in that manner at
2424 no cost to the student.
2525 SECTION 2. This proposed constitutional amendment shall be
2626 submitted to the voters at an election to be held November 6, 2018.
2727 The ballot shall be printed to permit voting for or against the
2828 proposition: "The constitutional amendment prohibiting the
2929 authorization or funding of a voucher program or similar program
3030 under which state revenue is used to pay the costs of a student's
3131 attendance at a private elementary or secondary school."
