| 9 | 9 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Article VII, Texas Constitution, is amended by |
|---|
| 11 | 11 | | adding Section 7 to read as follows: |
|---|
| 12 | 12 | | Sec. 7. (a) In this section, "private school" means a |
|---|
| 13 | 13 | | nongovernmental educational establishment that exists for the |
|---|
| 14 | 14 | | general education of elementary or secondary students. |
|---|
| 15 | 15 | | (b) The legislature may not appropriate money for or |
|---|
| 16 | 16 | | authorize a voucher program, education savings account, tax credit |
|---|
| 17 | 17 | | scholarship program, or similar program under which state revenue |
|---|
| 18 | 18 | | is used to pay all or any part of the costs of a student's attendance |
|---|
| 19 | 19 | | at a private school. |
|---|
| 20 | 20 | | (c) This section does not prohibit the use of state revenue |
|---|
| 21 | 21 | | to pay all or any part of the costs of attendance at a private school |
|---|
| 22 | 22 | | by a student with a disability if the student is entitled under |
|---|
| 23 | 23 | | federal law to receive special education services in that manner at |
|---|
| 24 | 24 | | no cost to the student. |
|---|
| 25 | 25 | | SECTION 2. This proposed constitutional amendment shall be |
|---|
| 26 | 26 | | submitted to the voters at an election to be held November 6, 2018. |
|---|
| 27 | 27 | | The ballot shall be printed to permit voting for or against the |
|---|
| 28 | 28 | | proposition: "The constitutional amendment prohibiting the |
|---|
| 29 | 29 | | authorization or funding of a voucher program or similar program |
|---|
| 30 | 30 | | under which state revenue is used to pay the costs of a student's |
|---|
| 31 | 31 | | attendance at a private elementary or secondary school." |
