| 7 | 7 | | relating to prohibiting governmental contracts with a company |

| 8 | 8 | | engaged in planning, constructing, or maintaining the border wall |

| 9 | 9 | | between the United States and Mexico. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 2252.151, Government Code, as effective |
|---|
| 12 | 12 | | September 1, 2017, is amended by amending Subdivision (1) and |
|---|
| 13 | 13 | | adding Subdivision (1-a) to read as follows: |
|---|
| 14 | 14 | | (1) "Border wall" means a wall, fence, or other |
|---|
| 15 | 15 | | barrier on the border between the United States and Mexico. |
|---|
| 16 | 16 | | (1-a) "Company" has the meaning assigned by Section |
|---|
| 17 | 17 | | 2270.0001 [806.001]. |
|---|
| 18 | 18 | | SECTION 2. Subchapter F, Chapter 2252, Government Code, as |
|---|
| 19 | 19 | | added by S.B. No. 252, Acts of the 85th Legislature, Regular |
|---|
| 20 | 20 | | Session, 2017, as effective September 1, 2017, is amended by adding |
|---|
| 21 | 21 | | Section 2252.1525 to read as follows: |
|---|
| 22 | 22 | | Sec. 2252.1525. CONTRACTS WITH COMPANIES ENGAGED IN CERTAIN |
|---|
| 23 | 23 | | ACTIVITIES RELATED TO BORDER WALL PROHIBITED. A governmental |
|---|
| 24 | 24 | | entity may not enter into a governmental contract with a company |
|---|
| 25 | 25 | | that is identified as engaged in the planning, construction, or |
|---|
| 26 | 26 | | maintenance of the border wall on the list prepared and maintained |
|---|
| 27 | 27 | | under Section 2252.153. |
|---|
| 28 | 28 | | SECTION 3. Section 2252.153, Government Code, as effective |
|---|
| 29 | 29 | | September 1, 2017, is amended to read as follows: |
|---|
| 30 | 30 | | Sec. 2252.153. LISTED COMPANIES. The comptroller shall |
|---|
| 31 | 31 | | prepare and maintain, and make available to each governmental |
|---|
| 32 | 32 | | entity, a list of companies known to: |
|---|
| 33 | 33 | | (1) have contracts with or provide supplies or |
|---|
| 34 | 34 | | services to a foreign terrorist organization; or |
|---|
| 35 | 35 | | (2) be engaged in the planning, construction, or |
|---|
| 36 | 36 | | maintenance of the border wall, including by providing: |
|---|
| 37 | 37 | | (A) supplies, equipment, or other personal |
|---|
| 38 | 38 | | property; or |
|---|
| 39 | 39 | | (B) personnel. |
|---|
| 40 | 40 | | SECTION 4. The changes in law made by this Act apply only to |
|---|
| 41 | 41 | | a contract or purchase for which a governmental entity first |
|---|
| 42 | 42 | | advertises or otherwise solicits bids, proposals, offers, or |
|---|
| 43 | 43 | | qualifications on or after the effective date of this Act. |
|---|
| 44 | 44 | | SECTION 5. This Act takes effect December 1, 2017. |
