55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to prohibiting governmental contracts with a company
88 engaged in planning, constructing, or maintaining the border wall
99 between the United States and Mexico.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 2252.151, Government Code, as effective
1212 September 1, 2017, is amended by amending Subdivision (1) and
1313 adding Subdivision (1-a) to read as follows:
1414 (1) "Border wall" means a wall, fence, or other
1515 barrier on the border between the United States and Mexico.
1616 (1-a) "Company" has the meaning assigned by Section
1717 2270.0001 [806.001].
1818 SECTION 2. Subchapter F, Chapter 2252, Government Code, as
1919 added by S.B. No. 252, Acts of the 85th Legislature, Regular
2020 Session, 2017, as effective September 1, 2017, is amended by adding
2121 Section 2252.1525 to read as follows:
2222 Sec. 2252.1525. CONTRACTS WITH COMPANIES ENGAGED IN CERTAIN
2323 ACTIVITIES RELATED TO BORDER WALL PROHIBITED. A governmental
2424 entity may not enter into a governmental contract with a company
2525 that is identified as engaged in the planning, construction, or
2626 maintenance of the border wall on the list prepared and maintained
2727 under Section 2252.153.
2828 SECTION 3. Section 2252.153, Government Code, as effective
2929 September 1, 2017, is amended to read as follows:
3030 Sec. 2252.153. LISTED COMPANIES. The comptroller shall
3131 prepare and maintain, and make available to each governmental
3232 entity, a list of companies known to:
3333 (1) have contracts with or provide supplies or
3434 services to a foreign terrorist organization; or
3535 (2) be engaged in the planning, construction, or
3636 maintenance of the border wall, including by providing:
3737 (A) supplies, equipment, or other personal
3838 property; or
3939 (B) personnel.
4040 SECTION 4. The changes in law made by this Act apply only to
4141 a contract or purchase for which a governmental entity first
4242 advertises or otherwise solicits bids, proposals, offers, or
4343 qualifications on or after the effective date of this Act.
4444 SECTION 5. This Act takes effect December 1, 2017.
